A. REQUEST
Estrellita Sibila, Esquire, on behalf of JMPE Holdings, LLC, JP Expansion Holdings, LLC,
and Tartan Warehouse, LLC, (the "Applicants") pursuant to Chapter 55, Section 55-15(a)
of the City of Miami Code of Ordinances, as amended, (the "City Code"), requests to
vacate and close a fifteen foot (15') wide public alley that runs east from an existing private
property line for approximately 143.85 feet, generally located between and parallel to
Northeast 71 Street and Northwest 72 Street and terminating at Northwest 5 Place, Miami,
Florida, (the "Alley").
B. RECOMMENDATION
Pursuant to Chapter 55, Section 55-15(a) of the City of Miami Code of Ordinances, as
amended, the Plat and Street Committee and Planning Department recommend Approval
with Conditions of the requested vacation and closure a public alley based on the facts
and findings in this staff report.

C. BACKGROUND
On June 27, 1925, the ANNA FLORENCE SUBDIVSION plat was recorded in Plat Book
18, Page 23, of the Public Records of Miami -Dade County, Florida.
On May 1, 2025, the City of Miami Plat and Street Committee approved the Liberty
Mission Tentative Plat #2069-A (the "Tentative Plat") by a vote of 5 to 0
D. SITE LOCATION AND SURROUNDING USES
The Alley is generally located at the northwest corner of Northwest 5 Place and
Northwest 71 Street, while the Property is bounded by Northwest 5 Place to the east and
Northwest 71 Street to the south.

E. PROPOSAL
The Applicant is proposing to vacate and close a fifteen foot (15') wide public alley that
runs east from an existing private property line for approximately 143.85 feet, generally
located between and parallel to Northeast 71 Street and Northwest 72 Street and
terminating at Northwest 5 Place
F. ANALYSIS
Chapter 55, Section 55-15(c)
Pursuant to Chapter 55, Section 55-15(c) of the City Code, "In addition to review for
technical compliance, the plat and street committee shall also consider the request for

vacation and closure with respect to the following:"
Criteria 1:
Is it in the public interest, or would the general public benefit
from the vacation of the rights- of -way or easement?
Finding 1:
The alley is a dead-end alley with no connectivity to the west with
N.W. 6 Avenue. Over the years the alley has become unsightly, and
conducive to criminal activity. Vacating and closing the alley will allow
the area to be secured private property, eliminating the potential for
criminal activity, and it would decrease the expenditure of police
resources in the subject alley.
Criteria 2:
Is the general public no longer using the rights of way or easement?
including public service vehicles such as trash and garbage trucks,
police, fire, or other emergency vehicles?
Finding 2:
The general public is not using the alley, as it does not provide
access through the block. Service vehicles such as trash and
garbage trucks, police, fire or emergency vehicles do not use the
alley, they use the adjacent streets of N.W. 5 Place and N.W. 71
Street. Also, at the east end of the alley, there is a structural support
column for Interstate 1-95 which reduces the access for large service
vehicles, such as garbage and fire trucks.
Criteria 3:
Would there be no adverse effect on the ability to provide
police, fire, or emergency services?
Finding 3:
There would be no adverse effect on the ability to provide police,
fire or emergency services, as such services are able to access the
properties via N.W. 5 Place and N.W. 71 Street. The alley dead
ends on its west side, where there is a private driveway on private
property for exclusive use of the property owner. Access to the
alley is further impeded on its east end by a support column of
Interstate 1-95.
Criteria 4:
Would the vacation and closure of the rights of way or
easements have a beneficial effect on pedestrian and vehicular
circulation in the area?
Finding 4:
Pedestrian and vehicular circulation in the area would not be affected
by the closure of the alley. The alley has proven to be an unsafe
environment for pedestrians. Over the years several incidents have
been reported in and around the alley, requiring police involvement.
These incidents range from trespass, petty crime, solicitation,
drug dealing, and even murder. The alley is not a safe place for
pedestrians. Pedestrian circulation can use the existing public
sidewalks along N.W. 71 Street and N.W. 5 Place frontages. Vehicles
circulating the alley, to the west, to access N.W. 6 Avenue would be
trespassing on private property.

G. FINDINGS
• The Applicants are the owners of the property located at 7136 Northwest 5 Court, 585
Northwest 71 Street, and 571 Northwest 71 Street (the "Property").
• The Property is bounded by Interstate 95 to the east and Northwest 71 Street to the south.
• The Alley is generally located at the northwest corner of Northwest 5 Place and Northwest
71 Street.
• The Property is located in the "D1," Work Place District Zone.
• The Property is located within the Miami Comprehensive Neighborhood Plan's ("MNCP")
Future Land Use designation of "Light Industrial."
• The Property currently consists of 46,349.08 +/- square feet acres of land.
• The Alley consists of 2,157.82 +/- square feet of land.
• After the proposed vacation and closure of the Alley, the Property, together with the Alley,
will consist of 28,508.27 +/- square feet (0.654 +/- acres) of land.
• The perimeter of the Property, together with the Alley, will be approximately 698.890 +/-
feet.
• The Alley dead ends on private property to the west and access on the east is impeded
due to an 1-95 support column.
• The request to close, vacate, and abandon from public use the Alley at the Property is to
install a gate and safeguard the Property from ongoing criminal activity.
• The Applicant is not proposing to redevelopment of the Property, together with the closure;
and
• The Applicant provided a graphic summary of City of Miami Police Data Incident Report for
2010-2024.
• On May 1, 2025, the City of Miami Plat and Street Committee approved the Tentative Plat
byavote of5to0.
• The Plat and Street Committee reviewed the request for the vacation and closure of the
Alley pursuant to the criteria as set forth in Chapter 55, Section 55-15.
• The Plat and Street Committee found the request to comply with the criteria.
• Pursuant to the provisions of Chapter 55, Section 55-15(a) of the City Code, as amended,
the City's Department of Resilience and Public Works and Office of Capital Improvements
researched for any City projects involving the Alley.
• Signed letters were provided confirming that the City has not expended any funds within
the prior fifty (50) years and/or any restricted funds on improvements.

CONCLUSION
Pursuant to Chapter 55, Section 55-15(a) of the City of Miami Code of Ordinances, as
amended, the City of Miami Plat and Street Committee and Planning Department
recommends Approval with Conditions of the requested vacation and closure of a public
alleys based on the facts and findings in this staff report.
CONDITIONS
1. Tentative Plat #2069-A ("Liberty Mission Plat") shall be developed in accordance with the
survey digitally signed and sealed by Odalys C. Bello-Iznaga, Professional Surveyor and
Mapper, LS No. 6169 on September 11, 2025, and approved by the Plat and Street
Committee, bearing the e-Plan approval stamp PZ-25-19435.
2. The Applicant, owner or its successor shall comply with the conditions of approval stated
for Liberty Mission Plat #2069-A, in the letter dated May 20, 2025, issued by the
Department of Resilience and Public Works.
3. The Applicant, owner, or successor shall meet applicable development standards
identified in the Miami 21 Code and all applicable local, county, state, and federal
regulations.
4. The Applicant, owner, or their successor shall provide an access plan for review and
acceptance by the City's Fire -Rescue, Police, Solid Waste Departments, and the Capital
Improvements Program/Office Transportation.
5. Approval of the requested vacation and closure shall be valid for a period of four (4) years
and shall remain independent of the referenced tentative plat during this period, pursuant
to Section 55-15 of the City of Miami Code of Ordinances, as amended.
6. A Certificate of Occupancy shall only be issued after all the required improvements have
been completed.
7. The City reserves the right to inspect the site to ensure compliance with the conditions
listed.
