See Exhibit A, Assemblage Addresses and Folio Numbers. This letter shall serve as the required letter of intent in support of a re -zone of the Assemblage from CI and T3-O to a unified and successional T4-L. This application includes acceptance of a proffered declaration of restrictions and will be filed concurrently with a future land use plan map amendment from Major Public Facility and Duplex Residential to Low Density Restricted Commercial. The Applicant's goal is to develop the Assemblage in a unified manner with low - scale mixed -income residential units. Assemblage Description. The Assemblage has approximately 285 linear feet of frontage on NW 1 Place, approximately 122 linear feet of frontage on NW 61 Street, and approximately 223 linear feet of frontage on NW 60 Street. The lot area of the Assemblage is approximately 49,259 square feet in size. The Assemblage is idle, vacant land in the City's Little Haiti neig hborhood. At the various intersections of this community are commercial activity nodes, with local retail and restaurant uses. To the south, east, and north are a variety of single-family, duplex, and multi -family uses. To the west of the Assemblage is a large public high school campus, iTech @ Miami's Mega Technology Magnet High School and Miami Edison Senior High School. There is no transition or buffer between this major public facility and the surrounding neighborhood. This is an ideal location for infill density, reversing urban sprawl with property access on three frontages. Development of the Assemblage will also improve the streetscape, with new sidewalks and trees. Future Land Use Map. The Future Land Use Map ("FLUM") of the City's Comprehensive Neighborhood Plan ("MCNP") designates the Assemblage "Major Institutional, Public Facilities, Transportation, and Utilities" and "Duplex Residential. See Figure 2, FLUM Excerpt, below. To the east of the Assemblage is designated "Duplex Residential." Within the same block to the east and one -block south is designated "Medium Density Multifamily Residential" and one -block north of the Assemblage, along NW 62 Street is designated "Restricted Commercial." Between the Major Institutional, Public Facilities, Transportation, and Utilities and the Medium Density Multifamily Residential there is no transition area. The Assemblage has two different zoning transect designations. The Miami 21 Zoning Code ("Miami 21") GIS Atlas designates the Property "Cl", Civic Institutional and "T3-O", Sub -Urban Transect. See Figure 3, Zoning Excerpt, below. The portion of the Assemblage that is zoned CI is privately owned. In the CI Transect, the only permitted residential use is a dormitory by Exception. Additionally, there are no uses permitted as of right. This results in extreme hardship to develop the idle, vacant land in a meaningful way that will support the local businesses and add to the housing supply. Figure 3. The Applicant is seeking to improve the current site condition with the Application, so that the Assemblage may be redeveloped with a more cohesive transition of development standards and uses. Accordingly, the Applicant is requesting a small-scale amendment of the FLUM so the entire Assemblage is Low Density Restricted Commercial, which will be processed concurrently, and a zone change from CI and T3-O to a transitionary T4-L. Additionally, through the public hearing process the Applicant will be seeking acceptance of a proffered declaration of restrictions. The Applicant is committing that twenty percent (20%) of the units will be marketed and maintained as affordable for persons within eighty percent (80%) of the area median income. Analysis. Article 7, Section 7.1.2.8(a)(1) of Miami 21, when a CI zoned property ceases to be used for Civic functions, the successional rezoning is determined by identifying the lowest Intensity Abutting Transect Zone, and rezoning to that Zone's next higher Intensity Zone. Between 2017 and 2018, the structure on the Assemblage was demolished and the land has been vacant since. The Applicant is proposed a rezoning to T4 because it is the next higher intensity zone to the surrounding T3-O properties. Additionally, of Article 7, Section 7.1.2.8(c) of Miami 21 states that a rezoning of land will only be considered where the proposal involves an extension of an existing transect boundary, unless the rezoning involves at least 40,000 square feet of land area or 200 feet of street frontage on one street. Here, the Property is over 40,000 square feet and over 200 feet of frontage on multiple frontages. Thus, the Applicant's requested change is consistent with successional rezoning requirement and meets the minimum land area and the minimum frontage required. As further described below and in accordance with Section 7.1.2.8(f) of Miami 21, approval of the Application will advance many of the MCNP's goals, objectives and policies. Section 7.1.2.8(f)(1)(a) of Miami 21 provides that for all amendments there is consideration of the relationship of the proposed amendment to the goals, objectives and policies of the Comprehensive Plan, with appropriate consideration as to whether the proposed change will further the goals, objectives and policies of the Comprehensive Plan; the Miami 21 Code; and other City regulations. The proposed future land use designation of Restricted Commercial is consistent with the MCNP's "Correspondence Table — Zoning and Comprehensive Plan." See Page 27, MCNP excerpt below. Approval of this Application will create a transition area between the major public facilities to the west and the rest of the surrounding residential areas to allow for mixed - income, affordable housing solutions. The infill of the vacant, blighted lots will considerably improve the viability and quality of life for the immediate area and the overall housing crisis in the City. This Application will provide a new housing opportunity for students and employees of the abutting school and the future residents will further support the local businesses in this area. Policy LU-1.1.7:: Land development regulations and policies will allow for the development and redevelopment of well -designed mixed -use neighborhoods that provide for the full range of residential, office, live/work spaces, neighborhood retail, and community facilities in a walkable area and that are amenable to a variety of transportation modes, including pedestrianism, bicycles, automobiles, and mass transit. Approval of the Application will allow for infill of idle, vacant land that will buffer the large educational facilities from the single-family, duplex, and multi -family neighborhood with mixed -income housing. Specifically, the derelict sidewalks and lack of street trees or proper curb and drainage will be improved. Policy HO-1.1.8: Through the land development regulations, the City will protect existing viable neighborhoods in those areas suitable for housing and, where appropriate, enhance them in a manner compatible with their existing character. Development of the Assemblage will protect the existing residential portions of the Little Haiti neighborhood. The Application will enhance the existing character with a transition of land use and zoning, and provide additional, suitable housing opportunities where there is vacant, idle land. HO-1.1.9 and LU-1.1.10: The City's land development regulations will encourage high -density residential development and redevelopment in close proximity to Metrorail and Metromover stations. This policy does not exclude increasing density and urban infill to provide additional housing opportunities in other areas of the City. The applicant is not proposing a high -density designation, rather a more transitionary designation that will enhance the existing area. The proposed Low -density Restricted Commercial future land use designation and T4-L zoning are unlike the high -density residential development and redevelopment near urban centers The Property is idle vacant land, within a donut hole of Transit Corridors. The Application will provide an appropriate transition and further contribute to the extreme housing shortage in close proximity to public transit, schools, and neighborhood uses. Objective LU-1.6: Regulate the development or redevelopment of real property within the city to insure consistency with the goals, objectives and policies of the Comprehensive Plan. Lastly, Section 7.1.2.8(f)(1)(b) of Miami 21 provides that there is a need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed change necessary. One notable change is that the Assemblage is no longer used for civic uses and was sold by a not -for -profit entity to a private owner in 2022. Since 2018, the Assemblage has been idle, vacant land, not supporting or contributing to the community. A FLUM change and rezone will allow the development of the Assemblage to stimulate a safer and more walkable area. This will directly contribute to the hosing supply for a mix of incomes, in close proximity to schools, churches and between 1-95 and Miami Avenue. Approval of this application will allow the redevelopment of the Property in a manner that advances many of the goals, objectives and policies of the MCNP as outlined here, as well as the minimum rezoning requirements provided in Miami 21. The Application will drastically improve the streetscape and is a needed forward -thinking investment, to improve this mixed -residential community and with beautiful new architecture. Conclusion. This Application satisfies the rezoning requirements provided in Miami 21, with a successional zoning classification that responds to the existing conditions of the City, and is consistent with the goals, objectives and policies of the MCNP. Further, this Application will facilitate the development idle, vacant land that will be consistent with the surrounding context of residential uses. Approval of the Application will allow for infill of idle, vacant land that will buffer the large educational facilities from the single-family, duplex, and multi -family neighborhood with mixed -income housing. This will directly enhance the walkability of the neighborhood to and from the schools or the multiple public transit stops on NW 60 Street and NW 62 Street. Specifically, the derelict sidewalks and lack of street trees or proper curb and drainage will be improved. Policy HO-1.1.8: Through the land development regulations, the City will protect existing viable neighborhoods in those areas suitable for housing and, where appropriate, enhance them in a manner compatible with their existing character. Development of the Assemblage will protect the existing residential portions of the Little Haiti neighborhood. The Application will enhance the existing character with a transition of land use and zoning, and provide additional, suitable housing opportunities where there is vacant, idle land. HO-1.1.9 and LU-1.1.10: The City's land development regulations will encourage high -density residential development and redevelopment in close proximity to Metrorail and Metromover stations. One notable change is that the Assemblage is no longer used for civic uses and was sold by a not -for -profit entity to a private owner in 2022. Since 2018, the Assemblage has been idle, vacant land, not supporting or contributing to the community. A FLUM change and rezone will allow the development of the Assemblage to stimulate a safer and more walkable area. See Exhibit C, Context Photos. The Applicant is also proposing to voluntary commit twenty percent (20%) of the units will be marketed and maintained as affordable for persons within eighty percent (80%) of the area median income, which is considered Low Income Housing. This will directly contribute to the hosing supply for a mix of incomes, in close proximity to schools, churches and between 1-95 and Miami Avenue. Approval of this application will allow the redevelopment of the Property in a manner that advances many of the goals, objectives and policies of the MCNP as outlined here, as well as the minimum rezoning requirements provided in Miami 21. The Application will drastically improve the streetscape and is a needed forward -thinking investment, to improve this mixed -residential community and with beautiful new architecture. Conclusion.
