A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE ALLOCATION OF FUNDS FROM THE DISTRICT 1
SHARE OF THE CITY'S MIAMI FOR EVERYONE ("MFE") PROGRAM, ON A
LUMP SUM BASIS, IN A TOTAL AMOUNT NOT TO EXCEED THREE
HUNDRED SIXTY THOUSAND AND 00/100 DOLLARS ($360,000.00), TO
MIAMI RIVER FUND, INC., A FLORIDA NOT -FOR -PROFIT 501(C)(3)
CORPORATION, AS THE FINANCIAL AGENCY FOR THE MIAMI RIVER
COMMISSION, FOR THE PURPOSE OF INSTALLING AND OPERATING NINE
(9) QUALITY IMPROVEMENT DEVICES AND THREE (3) WATER QUALITY
DEVICES, SUBJECT TO AVAILABILITY OF FUNDS AND PRIOR BUDGETARY
APPROVAL; ALLOCATING FUNDS FROM DISTRICT 1 PROJECT D1 000-
D1 MFE FOR SAID PURPOSE; FURTHER AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER
DOCUMENTS, INCLUDING AMENDMENTS, RENEWALS, AND EXTENSIONS,
ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE
DEEMED NECESSARY FOR SAID PURPOSE, SUBJECT TO ALL
ALLOCATIONS, APPROPRIATIONS, AND PRIOR BUDGETARY APPROVALS,
AND IN COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AND IN COMPLIANCE
WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS; PROVIDING
FOR AN EFFECTIVE DATE.

WHEREAS, on April 13, 2023, pursuant to Resolution No. R-23-0178, the City of Miami
("City") created the Miami For Everyone ("MFE") Program to assist communities facing the long-
term complications resulting from declared emergencies and to address the specific needs of
the most vulnerable residents and businesses, through a strategy of focusing the provision of
support towards priority areas of need that will further stabilize economic conditions within City
Districts; and
WHEREAS, the City and the Miami River Commission ("MRC") have an interest in the
health and cleanliness of the Miami River; and
WHEREAS, the MRC was established by Section 163.06, Florida Statutes, as the official
clearinghouse for all public policy and projects related to the Miami River and is funded by the
Florida Department of State, Florida Department of Transportation, Miami -Dade County, the
City, and private sector donations; and
WHEREAS, MRC has submitted a grant application, attached hereto and incorporated
herein as Exhibit "A," to implement a one-year pilot cleanup project designed to address health -
threatening bacteria violations in Wagner Creek and the Seybold Canal through the installation

of nine (9) water quality improvement devices and three (3) water quality sample devices (the
"Project"); and
WHEREAS, the MRC agrees to provide the Services in conjunction with its other
ongoing projects to maintain the health and beauty of the Miami River; and
WHEREAS, the City's District 1 Commissioner ("Commissioner") wishes to provide grant
funds from the Commissioner's share of the City's MFE Program funds, in a lump -sum basis, in
an amount not to exceed Three Hundred Sixty Thousand and 00/100 Dollars ($360,000.00)
("Funds") for the Project; and
WHEREAS, Section 18-112 of the Code of the City of Miami, Florida, as amended ("City
Code"), authorizes the City to enter into an agreement with other governmental agencies or
state funded institutions for the purchase or acquisition of goods or services without competitive
bidding procedures subject to City Commission approval for purchases over Fifty Thousand
and 00/100 Dollars ($50,000.00); and
WHEREAS, the City Manager is requesting authority from the City Commission to
negotiate and execute any and all documents necessary, all in forms acceptable to the City
Attorney, for the allocation of the Funds for the Project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to allocate the Funds from the
Commissioner's share of the City's MFE Program funds to MRC for the Project.
Section 3. Funds are hereby allocated from District 1 Project D1 000-D1 MFE, subject to
the availability of funds and prior budgetary approval.
Section 4. The City Manager is further authorized' to negotiate and execute any and all
other documents, including any amendments, renewals, and extensions, all in forms acceptable
to the City Attorney, as may be deemed necessary for said purpose, subject to all allocations,
appropriations, and prior budgetary approvals, and in compliance with all applicable provisions
of the City Code, and in compliance with all applicable laws, rules, and regulations.
Section 5. This Resolution shall become effective immediately upon its adoption.
APPROVED AS TO FORM AND CORRECTNESS:
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
