Home My WebLink AboutR-26-0216City of Miami Resolution R-26-0216 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 19132 Final Action Date: 5/14/2026 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AFTER A DULY NOTICED PUBLIC HEARING, AUTHORIZING AND DIRECTING THE CITY MANAGER TO TAKE ANY AND ALL ACTION(S) NECESSARY TO EXPEDITIOUSLY REQUEST THE MIAMI-DADE COUNTY DEPARTMENT OF TRANSPORTATION AND PUBLIC WORKS ("DTPW') TO CONSIDER THE PROPOSED TRAFFIC FLOW MODIFICATIONS AND WAIVE THE REQUIRED RESIDENT CONCURRENCE AND EXEMPT THE BALLOTING PROCESS IN ORDER TO EXPEDITIOUSLY PROCEED WITH THE DESIGN AND CONSTRUCTION OF TRAFFIC CALMING DEVICES AT THIRTY-SIX (36) LOCATIONS IN THE RESIDENTIAL NEIGHBORHOODS OF DISTRICT 4, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED; DIRECTING THE CITY CLERK TO SEND A CERTIFIED COPY OF THIS RESOLUTION TO THE DTPW DIRECTOR. SPONSOR(S): Commissioner Ralph "Rafael" Rosado WHEREAS, several locations in the City of Miami's ("City") District 4 residential neighborhoods are experiencing significant cut -through traffic and speeding during rush hour periods; and WHEREAS, such cut -through traffic and speeding on local residential streets that are not designed for such volume diminishes residents' quality of life; and WHEREAS, in addition to quality -of -life problems such as noise and general congestion, such cut -through traffic and speeding creates significant life -safety risks as residential streets are narrower than nearby arterial roadways, increasing the risk of vehicular accidents, including those involving pedestrians; and WHEREAS, those who cut -through residential neighborhoods during rush hour traffic tend to disobey posted speed limits and signage to gain an advantage over using arterial roadways meant for such traffic; and WHEREAS, in order to alleviate these issues, the City proposes to install thirty-six (36) traffic calming devices at these locations in the residential neighborhoods, as described in Exhibit "A," attached and incorporated herein, that experience significant cut -through traffic and speeding during morning and afternoon rush hour periods; and WHEREAS, Section 1.6.a of the Miami -Dade County Traffic Flow Modification(s)/Street Closure(s) Procedure, attached and incorporated herein as Exhibit "B" ("County Procedure"), as revised by the Miami -Dade County Department of Transportation and Public Works ("DTPW') formerly known as the Miami -Dade County Public Works Department ("PWD") Traffic Engineering Division in January 2009, requires concurrence from the affected residents and/or property owners; and City of Miami Page 1 of 4 File ID: 19132 (Revision:) Printed On: 5/26/2026 File ID: 19132 Enactment Number: R-26-0216 WHEREAS, Section 1.7.c of the County Procedure further states that a municipality "in lieu of concurrence from the affected residents/property owners may elect to have their elected body vote the proposed traffic flow modification(s)/street closure(s) after public hearing and may submit the resolution to DTPW/PWD requesting consideration of the proposed traffic flow modification(s)/street closure(s);" and WHEREAS, in order to expeditiously address the aforementioned quality of life and life - safety issues, the City desires to install thirty-six (36) traffic calming devices, as more particularly described in Exhibit "A," attached and incorporated herein, in designated residential neighborhoods of District 4 without delay by holding a public hearing in lieu of resident/property owner concurrence through balloting; and WHEREAS, although the City is adopting this Resolution after a public hearing in lieu of concurrence, it is the intent of the City, to the best of its ability, to seek concurrence from the residential properties whose frontage directly abuts the proposed traffic calming devices, as are more particularly described in Exhibit "A," attached and incorporated herein; and WHEREAS, in lieu of concurrence from the affected residents and/or property owners, the City Commission finds it in the best interest of the City and its residents to pass a resolution after a public hearing requesting DTPW/PWD to consider the proposed traffic flow modification(s)/street closure(s) as described in Exhibit "A," attached and incorporated herein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Commission, after a duly noticed public hearing, authorizes' and directs the City Manager to take all actions necessary to expeditiously request that DTPW/PWD consider the proposed traffic flow modification at the following thirty-six (36) locations within District 4, as more particularly described in Exhibit "A," attached and incorporated herein, in order to expeditiously proceed with design and construction of the traffic calming devices: 1. Southwest Twelfth Street between Southwest Twenty -Second Avenue and Southwest Twenty -Third Avenue 2. Southwest Twelfth Street between Southwest Twenty -Third Avenue and Southwest Twenty -Fourth Avenue 3. Southwest Thirteenth Street between Southwest Twenty -Third Court and Southwest Twenty -Third Avenue 4. Southwest Thirteenth Street between Southwest Twenty -Fifth Avenue and Southwest Twenty -Seventh Avenue 5. Southwest Sixth Street between Southwest Twenty -Second Avenue and Southwest 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions.
