Background of Item: Several locations in the City of Miami's ("City") District 2 residential neighborhoods are experiencing significant cut -through traffic and speeding during rush hour periods. Such cut -through traffic and speeding on local residential streets that are not designed for such volume diminishes residents' quality of life. In order to alleviate these issues, the City proposes to install eight (8) traffic calming devices at these locations in the residential District 2 neighborhoods, as described in Exhibit "A," attached. Section 1.6a of the Miami -Dade County Traffic Flow Modification(s)/Street Closure(s) Procedure, as revised by the Miami -Dade County Public Works Department ("PWD") Traffic Engineering Division in January 2009, attached and incorporated as Exhibit "B" ("County Procedure"), requires concurrence from the affected residents and/ or property owners. Section 1.7c of the County Procedure further states: "Municipal Jurisdictions: In lieu of concurrence from the affected residents and/or property owners, a municipality may pass a resolution after a public hearing requesting PWD to consider the proposed traffic flow modification(s)/street closure(s)". In order to expeditiously address the above, the City desires to hold a public hearing in lieu of resident/property owner concurrence through balloting. Although the City is adopting this Resolution after a public hearing in lieu of concurrence, it is the intent of the City, to the best of its ability, to seek concurrence from the residential properties whose frontage directly abuts the proposed traffic calming devices, as are more particularly described in Exhibit "A". In lieu of concurrence from the affected residents and/or property owners, the City Commission finds it in the best interest of the City and its residents to pass a resolution after a public hearing requesting PWD/DTPW to consider the proposed traffic flow modification(s)/street closure(s). The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Commission, after a duly noticed public hearing, authorizes' and directs the City Manager to take all actions necessary to expeditiously request that DTPW/PWD consider the proposed traffic flow modification at the following eight (8) locations within District 2, as more particularly described in Exhibit "A", attached and incorporated herein, in order to expeditiously proceed with design and construction of the traffic calming devices: 1. Crawford Avenue between Kent Court and Kent Road 2. Poinciana Avenue between La Playa Boulevard and Braganza Avenue 3. El Prado Boulevard between Le Jeune Road and La Playa Boulevard 4. Malaga Avenue between Le Jeune Road and La Playa Boulevard 5. Barbarossa Avenue between Southwest 42nd Avenue and Braganza Avenue 6. Woodridge Road between Southwest 42nd Avenue and Brighton Place 7. Battersea Road between Ingraham Highway and Douglas Road 8. Elizabeth Street between Bird Avenue and Shipping Avenue Section 3. The City Clerk is directed to send a certified copy of this Resolution to the Director of Miami -Dade County's Department of Transportation and Public Works. Section 4. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions.
