Purpose of Item:
A Resolution of the Miami City Commission authorizing a donation in an amount not to
exceed Seventy -Five Thousand Dollars and 00/100 ($75,000.00) to Amplify Community
Resources, Inc., a Florida not for profit organization, for financial assistance in providing
a youth educational and development community programming in the City of Miami
("City") focusing on promoting mental, physical, and emotional well-being of the City's
youth; allocating funds from the Law Enforcement Trust Fund, Project Number 19-
690001, Award 1169, and Account Code 12500.191602.883000.0.0, such expenditures
having been approved by the Chief of Police and in compliance with the directives
provided in Section 932.7055, Florida Statutes, as amended.
Background of Item:
Section 932.7055, Florida Statutes, authorizes the expenditure of forfeiture cash or
proceeds for certain law enforcement purposes not considered normal operating
expenses. Pursuant to the provisions of Section 932.7055(5)(c)3., Florida Statutes, a
local law enforcement agency that acquires at least $15,000 pursuant to the Florida
Contraband Forfeiture Act within a fiscal year must expend or donate no less than 25
percent of such proceeds for the support or operation of any drug treatment, drug abuse
education, drug prevention, crime prevention, safe neighborhood, or school resource
officer program or programs. Local law enforcement agencies have the discretion to
determine which program, or programs will receive the designated proceeds. Pursuant
to Section 932.7055(5)(c), Florida Statutes, the recipient of such proceeds shall certify
that funds appropriated will be used lawfully and for the purpose stated, be required to
maintain proper accounting records for the expenditure of such monies, and provide any
reports, including but not limited to audit reports, as may be required. The City of Miami
("City") Police Department ("MPD") deems it is imperative to provide the City's youth
with a positive incentive program aimed to support crime prevention and safe
neighborhood programs. Amplify Community Resources, Inc., a Florida not for profit
organization ACR , is committed to the education and development of the youth within
underserved communities in the City of Miami ("City") to provide inspiration for success
and positive life changes. ACR's youth programs are designed to focus on enhancing
mental, physical, and emotional outcomes to benefit the youth of the City. ACR
integrates social -emotional learning techniques and comprehensive, evidence -based
curriculum to provide positive life skills including relationship -building modules, physical
activity, nutrition, conflict resolution and self -care. MPD, in furtherance of its
commitment to improving public safety within the jurisdictional boundaries of the City,
wishes to support objectives and provide financial assistance for the provision of
services to the City's underserved youth and build stronger, safer communities.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY OF
MIAMI ("CITY") POLICE DEPARTMENT TO PROVIDE A DONATION IN AN AMOUNT
NOT TO EXCEED SEVENTY-FIVE THOUSAND AND 00/100 DOLLARS ($75,000.00)
TO AMPLIFY COMMUNITY RESOURCES, INC., A FLORIDA NOT FOR PROFIT
ORGANIZATION, FOR FINANCIAL ASSISTANCE IN PROVIDING EDUCATIONAL
AND DEVELOPMENT YOUTH COMMUNITY PROGRAMMING IN THE CITY WITH A
FOCUS ON PROMOTING MENTAL, PHYSICAL, AND EMOTIONAL WELL-BEING;
ALLOCATING FUNDS FROM THE LAW ENFORCEMENT TRUST FUND, PROJECT
NUMBER 19-690001, AWARD 1169, AND ACCOUNT CODE
12500.191602.883000.0.0, SUCH EXPENDITURES HAVING BEEN APPROVED BY
THE CHIEF OF POLICE AND IN COMPLIANCE WITH THE DIRECTIVES PROVIDED
IN SECTION 932.7055, FLORIDA STATUTES, AS AMENDED.
WHEREAS, Section 932.7055, Florida Statutes, dictates the disposition of property
obtained or forfeited by law enforcement agencies pursuant to the Florida Contraband Forfeiture
Act; and
WHEREAS, pursuant to section 932.7055, Florida Statutes, law enforcement agencies
are authorized to destroy the property, sell the property at a public auction, or retain the property
for official use by agencies for certain law enforcement purposes not considered normal
operating expenses; and
WHEREAS, the provisions of Section 932.7055(5)(c)3, Florida Statutes, require that any
a local law enforcement agency that acquires at least $15,000.00 pursuant to the Florida
Contraband Forfeiture Act within a fiscal year must expend or donate no less than twenty-five
percent (25%) of such proceeds for the support or operation of any drug treatment, drug abuse
education, drug prevention, crime prevention, safe neighborhood, or school resource officer
program or programs; and
WHEREAS, law enforcement agencies have the discretion to determine which program
or programs will receive the designated proceeds; and
WHEREAS, pursuant to Section 932.7055(5)(c), Florida Statutes, the recipient of such
proceeds shall certify that funds appropriated will be used lawfully and for the purpose stated,
be required to maintain proper accounting records for the expenditure of such monies, and
provide any reports, including but not limited to audit reports, as may be required; and
WHEREAS, the City of Miami ("City") Police Department ("MPD") deems it is imperative

prevention and safe neighborhood programs; and
WHEREAS, the Amplify Community Resources, Inc., a Florida not for profit
organization (ACR"), is committed to the education and development of the youth within
underserved communities in the City to provide inspiration for success and positive life
changes; and
WHEREAS, ACR's youth programs are designed to focus on enhancing mental,
physical, and emotional outcomes to benefit the youth of the City; and
WHEREAS, ACR integrates social -emotional learning techniques and
comprehensive, evidence -based curriculum to provide positive life skills including
relationship -building modules, physical activity, nutrition, conflict resolution and self -care;
and
WHEREAS, MPD, in furtherance of its commitment to improving public safety within
the jurisdictional boundaries of the City, wishes to support objectives of ACR and provide
financial assistance for programming to benefit the City's underserved youth and building
stronger and safer communities; and
WHEREAS, the funds necessary to support ACR's expenditures have not been included
in the MPD's general operating budget and are available in MPD's Law Enforcement Trust Fund
("LETF"); and
WHEREAS, the Chief of Police recommends adoption of this Resolution and has
determined that the proposed expenditure of funds comply with the requirements of Section
932.7055, Florida Statutes;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The MPD is authorized' to provide a donation, in an amount not to exceed
Seventy -Five Thousand and 00/100 Dollars ($75,000.00), to ACR allocated from MPD's LETF
Project Number 19-690001, Award 1169, and Account Code 12500.191602.883000.0.0, for
financial assistance in providing educational and development youth community programming in
the City with a focus on promoting mental, physical, and emotional well-being in compliance
with the directives provided in Section 932.7055, Florida Statutes.
Section 3. This Resolution shall become effective immediately upon its adoption.
APPROVED AS TO FORM AND CORRECTNESS:
1 The herein authorization is further subject to compliance with all legal requirements that may
be imposed, including but not limited to, those prescribed by applicable City Charter and City
Code provisions.
