A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD,
RECOMMENDING TO THE MIAMI CITY COMMISSION APPROVAL OF AN
ORDINANCE AMENDING ORDINANCE NO. 13114, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED ("MIAMI 21 CODE"), BY AMENDING
ARTICLE 1, TITLED "DEFINITIONS," TO INTRODUCE AND CLARIFY DEFINITIONS
RELATED TO VESSELS; BY AMENDING ARTICLE 3, SECTION 3.6, TITLED
"GENERAL TO ZONES"/"OFF-STREET PARKING AND LOADING STANDARDS,"
AND ARTICLE 6, SECTION 6.1, TABLE 13, TITLED "SUPPLEMENTAL
REGULATIONS"1"INTENT AND EXCLUSIONS" TO CREATE CONSISTENCY WITH
THE DEFINITIONS AND ESTABLISH AND UPDATE REGULATIONS, PROCESSES,
AND BY RIGHT CRITERIA PERTAINING TO VESSELS, BOAT SLIPS, BOAT
HOUSES, AND DOCKS / PIERS; AND BY AMENDING ARTICLE 6, SECTION 6.3,
TITLED "SUPPLEMENTAL REGULATIONS"/"COMMERCIAL USES," TO ESTABLISH
A NEW SUBSECTION REGULATING MARINE -RELATED COMMERCIAL
ESTABLISHMENTS; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on October 22, 2009, the Miami City Commission adopted Ordinance No.
13114 as the Zoning Ordinance of the City of Miami, Florida, which has been amended from time
to time ("Miami 21 Code"); and
WHEREAS, the Office of the City Manager appointed a Steering Committee to evaluate
existing Miami 21 Code entitlements with the intent of identifying opportunities for process
improvements and recommending legislative amendments ("Entitlement Reform Program"); and
WHEREAS, the Committee determined that existing regulations for Vessels, Boat Slips,
Boat Houses, Docks/Piers, and related commercial activities are outdated, inconsistent, or
incomplete, creating administrative inefficiencies and uncertainty for applicants; and
WHEREAS, an amendment is needed to add the "Marine -Related Commercial
Establishment" subcategory under Article 6.3 to classify and regulate water -dependent and water -
related commercial operations; and
WHEREAS, the amendments streamline processes and reduce administrative
redundancy while ensuring neighborhood character is preserved and impacts on Abutting
properties are mitigated; and
WHEREAS, the Miami Comprehensive Neighborhood Plan ("MCNP") promotes the
creation of vibrant, pedestrian -friendly, and economically resilient urban environments through
policies that encourage mixed -use development, active ground -floor uses, and enhancement of
the public realm; and

WHEREAS, consideration has been given as to whether the proposed text amendment
will further the goals, objectives, and policies of the MCNP, the Miami 21 Code, and other City
regulations; and
WHEREAS, consideration has been given as the need and justification for the proposed
text amendment, including changed or changing conditions, that make the passage of the
proposed text amendment necessary.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND APPEALS
BOARD OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted and incorporated as if fully set forth in this Section.
Section 2. The Planning, Zoning and Appeals Board hereby recommends to the City
Commission Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, is further
amended by making modifications to Article 1 Definitions'. in the following particulars: [1]
"Article 1 `Definitions'
1.2 DEFINITION OF TERMS
Boat Lift: A device that raises and lowers a boat in and out of water and provides a stable and
secure way to store it. A Boat Lift is a component of a Dock 1 Pier.
Boat House: A Building located over an inland Boat Slip designed to shelter boats and store
related equipment.
Boat Slip: A docking space for a boat that allows access to a waterway and/or waterbody and
provides protection from wind and water currents. Also known as a berth, cut or basin.

Dock: A platform extending from the shore over water and used to secure and protect vessels
or allow pedestrian access to extend over water. Docks include associated Boat Lifts and
Mooring Piles. See Article 6.See Also known as a Pier.

House Barge --Houseboat: A Floating Structure or -used as a residence. A Vessel used as a
residence, a private pleasure craft, consisting of a hull and
`""t integral flotation devices, not suitable for rough water, and designed and manufactured
to be self-propelled. See Article 6. Also known as a Houseboat.

Floating Structure: A floating barge -like entity, with or without accommodations built thereon,
which is not primarily used as a means of transportation on water, but serves purposes or

provides services typically associated with a Structure or other improvement to real property.
The term "Floating Structure" includes, but is not limited to, each entity used as a residence,
place of business, office, hotel or motel, restaurant or lounge, clubhouse, meeting facility,
storage or parking facility, mining platform, dredge, dragline, or similar facility or entity
represented as such. Floating Structures, as defined herein, are expressly excluded from the
definition of the term "vessel" provided in section 327.02(27), Florida Statutes (1989), and is
also excluded from the definition of "private pleasure craft Recreational Vessel." Incidental
movement upon water shall not, in and of itself, preclude an entity from classification as a
Floating Structure. A Floating Structure is expressly included as a type of tangible personal
property (from section 192,001 (17), Florida Statutes (1989). See illustration included with
Ordinance No. 10932, adopted October 24, 1991.
Frontage: The area between a Building Facade and the vehicular lanes of a Thoroughfare,
Mean High waterline Mean High -Water Line of a Waterfront, or Frontage Line of a Civic Space
Type

Mean High Water Line: The intersection of the tidal plane of mean high water with the shore,
pursuant to Florida Statutes §177.27(15), as amended.

Minor Accessories: An optional part fitted to perform an additional function or enhance
performance. For Recreational Watercraft Vessel these include masts, antennae vent stacks
and windshields.

Mooring Piles: Vertical pole(s), often made of treated wood or steel, driven into the seabed to
secure a vessel. Mooring piles are a component of a Dock / Pier.

Pier: A platform extending from shore over water used to secure and protect vessels or allow
pedestrian access to extend over water. See Article 6. See Dock,
water, designed and outfittcd exclusively for recreational use.

Vessel: Any watercraft, power -driven or not, mobile or stationary, surface, subsurface or
hydrofoil, including but not limited to ships, boats, houseboats, air boats, and sea planes, but
excluding Floating Structures.
Vessel, Commercial: A vessel built, altered, or used for the principal purpose of engaging in
water -related commercial activity, including but not limited to charter boats, fishing boats, cruise
ships, and freighters.

Vessel, arivato pleasurd Craft Recreational: A vessel which is privately owned or leased
primarily for recreational purposes. Privato pleasure craft Recreational Vessel does not include
commercial, official, or scientific vessels. For regulatory purposes, Private pl asure-craft
Recreational Vessels are divided into two (2) classes: Minor: Under sixteen (16) feet in length;
Major: Sixteen (16) feet and over in length. Private pleasure craft, Recreational Vessel may or
may not contain facilities qualifying them as a Residential Use. Where they do contain such
facilities, the Use within the City limits shall be governed as--previded-in pursuant to this Code
and other applicable regulations. Also known as a Private Pleasure Craft or Recreational
Watercraft.
Section 3. The Planning, Zoning and Appeals Board hereby recommends to the City
Commission Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, is further
amended by making modifications to Article 3 `General to Zones' in the following particulars: [1]

3.6.3 ADDITIONAL OFF-STREET PARKING REGULATIONS

General performance standards for Off-street Parking facilities:
a, Parking shall be implemented so as to provide safe and convenient access to and from
public Thoroughfares which include movement lanes and Public Frontages.
b. Vehicular access through Residential properties for nonresidential Uses shall be
prohibited.
c. Off-street Parking spaces shall be located with sufficient room for safe and convenient
parking without infringing on any public Thoroughfare or sidewalk.
d. Off-street Parking spaces whose locations require that cars back into movement lanes
shall only be permissible in T3 and T4 zones. Backing into Alleys shall be permissible in
all Transect Zones.
e. Off-street Parking or loading area shall not be used for the sale, repair, or dismantling of
any vehicle or equipment, or for storage of materials or supplies.
f. Parking or storage of commercial trucks, buses, vans, sign trailers; trailers or semi-
trailers for freight, cargo; non Recreational Watercraft Recreational Vessels, or the like
shall not be permitted in any T3, T4, T5-R or T6-R Zone.
g. Inoperable vehicles and other inoperable Recreational Watercraft Recreational Vessels
or equipment shall be stored only in storage facilities or other approved places where
they are completely concealed from public view.

h. Except in connection with permitted active continuing construction on the premises,
construction equipment such as earth moving machines, excavators, cranes, and the
like shall only be allowed in DI, D2 and D3, as allowed by this Code.
i. All Off-street Parking shall comply with applicable regulations related to lighting, paving,
and drainage including the Miami -Dade County Code and the Florida Building Code.
j. Specific areas may be set aside for Tandem Parking. Tandem Parking in all Transect
Zones, except T3 and T4, shall be used only by a valet parking operator.
k. Parking facilities on adjoining Lots may share access points, driveways and parking
subject to a recorded covenant running with the property on which the facilities are
located, by process of Waiver.
I. Stationing of Recreation Watercraft Recreational Vessels:
1. Transect Zones The Sstationing of Recreational Watercraft -Recreational Vessels
may only be permitted in T3, T4-R and T4-L Transect Zones and only where
incidental to a Single -Family Residence. This section shall not be construed as
preventing the docking of boats along the waterfront.
2. Screening Screening arrangements shall be made to buffer view of the
Recreational Vessels from Abutting parcels by means of
walls, fences or landscaping of sufficient opaqueness to visually conceal its bulk
while in keeping with applicable provisions in Article 3 and 5.
3. Occupancy Recreational Vessels stationed in T3, T4-R
and T4-L Transect Zones shall not be used as Residential or other Occupancies.
4. Location The Sstationing of Recreational Watercraft Recreational Vessels may
only be permitted when placed within the Second or Third Layer of the property.
5. t=lcight The maximum height of the Recreational Watercraft Recreational Vessel
shall not exceed eight (8) feet, inclusive of trailer and excluding Minor Accessories.
6. State or condition Stationing of Recreational Vessels in
T3, T'I R and T'I L and T4 Transect Zones or when Abutting a T3 Transect Zone
may only be permitted as long as the Recreational Watercraft Recreational Vessel is
maintained in an orderly and seemly condition.

Commission Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida,
is further amended by making modifications to Article 4 `Standards and Tables' in the

6.3 Commercial Uses

6.3.8 Marine -Related Commercial Establishments
6.3.8.1 Marine -Related Commercial Establishments located within T5-L, T5-O, T6-L, and T6-0
Transect Zones (except when Abutting a T3 or T4-R Transect Zone) shall be allowed by Right
when all the following criteria are met:
1. Location
a. At the Ground level, the storage of Vessels and/or Floating Structures shall be
located in the Third Layer and concealed by a Liner or Streetscreen.
b. Above the Ground Level, the storage of Vessels and/or Floating Structures may
be located within the Second or Third Layer.

2. Height
a. Marine -Related Commercial Establishments shall be allowed up to the Height
allowable by Right of the underlying Transect Code, except as follows:
I. Abutting T3; 39 feet
II. Abutting T4; 50 feet
3. Design Standards
a. Where a Building cannot meet the Building Facade requirement (Article 5), it may
be modified by process of Waiver, as follows:
I. Reduced by a maximum of 30%; and/or
II. A portion of the Facade may be designed as a colonnade that includes a
Streetscreen of a minimum Height of 3.5 feet.
b. A solid and continuous masonry wall, a minimum of six feet in Height, whose
surfaces are stuccoed and/or painted, shall be provided along all Side and Rear
property lines.
c. A densely planted vegetation Screen shall be provided along all Side and Rear
property lines Abutting T3 or T4 Transect Zones or an existing Single -Family
Residence or Duplex, including the following components:
I. A combination of trees and shrubs using a variety of Florida -friendly species
pursuant to Article 9, Section 9.1, titled "Plant Quality," that will mature to
create a continuous visual Screen; and
Tree specimens shall have a 3" caliper and a minimum height of fourteen
(14) feet at planting and a minimum height of twenty-five (25) feet at
maturity, except where the height and location of overhead power -lines
requires the planting of low growing trees, which shall be a minimum height
of eight (8) feet and minimum caliper of two (2) inches at time of planting
and a mature height and spread not encroaching within five (5) feet of
overhead power -lines; and
111. Shrubs shall be planted at a maximum average spacing of thirty (30) inches
on center or if planted at a minimum height of thirty-six (36) inches, shall
have a maximum average spacing of forty-eight (48) inches on center and
shall be maintained so as to form a continuous, unbroken and solid visual
screen within one (1) year after time of planting.
4. Ambient Standards
a. Operations shall comply with the City's Noise Ordinance;
b. The operation of heavy lifting equipment may only take place during the hours of
7am and 8pm;

1. Max 2.0 foot-candles at Side and Rear.
II. All lighting shall minimize glare to adjacent properties and face inward.
6.3.8.2 When the above criteria are not met, approval of Marine -Related Commercial
Establishments may be obtained pursuant to Article 4, Table 3 'Building Function: Uses'.
Section 6. If any section, part of a section, paragraph, clause, phrase or word of this
Resolution is declared invalid, the remaining provisions of this Resolution shall not be affected.
Section 7. It is recommended to the City Commission that the provisions of the
Ordinance become and be made a part of the Miami 21 Code, which provisions may be
renumbered or relettered and that the word "ordinance" may be changed to "section", "article",
or other appropriate word to accomplish such intention.
Section 8. This Resolution shall become effective immediately upon adoption.
