Enclosed are two original fully executed Joinder by Owner for 3050 Biscayne Properties,
LLC and Joinder by Owner for 3195 Property, LLC (the "Joinders") which are a part of the
Settlement Agreement in the above -referenced case. As our office will be undergoing
construction, we are delivering the originals to your office for safe keeping.

JOINDER BY OWNER
The undersigned, 3195 Property, LLC, owner of the real property described as Lots 1, 2,
and 3, Block 4, of the Elwood Court Subdivision, recorded at Plat Book 9, Page 181 of the
Public Records of Miami -Dade County, Florida, hereby does hereby join in, acknowledge, and
consent to Sections 2.A)(iv) — (vi), 2.B) and 2(C) of the Settlement Agreement between West
Flagler Associates, Ltd. and the City of Miami and to the recording of instruments establishing
the additional permissible and prohibited uses on such property consistent with the terms of the
Settlement Agreement, and that such shall be binding upon the undersigned and its successors in
title and interest, but only as it relates to the real property described herein.
