A RESOLUTION ACCEPTING FROM DADE COUNTY
A RIGHT OF WAY DEED DATED DECEMBER 16,
1971, FOR RIGHT OF WAY ON N. W. 76TH
STREET BETWEEN N. W. 1ST COURT AND NORTH
MIAMI AVENUE.
WHEREAS, sanitary sewer construction is planned
on N. W. 76th Street which is not dedicated to full
width at certain points between N. W. 1st Court and
North Miami Avenue; and
WHEREAS, Mb Dade CountyallIMOMINNO, owner of
a portion of land which requires dedication, has
executed a right of way deed for a 25-foot strip of
land required for full width dedication;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the right of way deed dated
December 16, 1971, from Dade County for a 25-foot
strip of land at N. W. 76th Street between N. W. 1st
Court and North Miami Avenue, as more particularly
described in said right of way deed, copy of which is
attached hereto and by this reference made a part
hereof, be, and the same is hereby, accepted.
Section 2. That the proper officials of the
City be, and they are hereby, authorized and directed

THIS INDENTURE, Made this /A day' of J/O 3677 A.D. 19 7l ,
by and between the County of Dade, a body Corporate, and a Political Subdivision
of the State of Florida, party of the first part, and THE CITY OF MIAMI, a
Municipal corporation of the State of Florida, in the County of Dade, and its
successors in interest, party of the second part.
W ITNESSET H:
That the said party of the first part, for and in consideration of
the sum of One Dollar to it in hand paid by the party of the second part,
receipt whereof is hereby acknowledged, and for other and further good and
valuable considerations, does hereby grant, bargain and sell to the party of
the second part, and its successors in'interest, for the purpose of a public
highway and purposes incidental thereto, the following described land,
situate, lying and being in the County of Dade, State of Florida, to -wit;
The South 25.00 feet of Lots 5 and 6 in
Block II of PHOENIX PARK according to the
plat thereof recorded in Plat Book 6 at Page 80
of the Public Records of Dade County, Florida.
It is the intention of the party of the first part by this instru-
ment to convey to the said City, and its successors in interest, the land
above described for use as a public highway and for all purposes incidental
thereto.
It is expressly provided that if and when said highway shall be
lawfully and permanently discontinued, the title to the said above' described
land shall immediately revert to the party of the first part, its successors
and assigns, and it or they shall have the right. to immediately re -possess
the same. % f

IN WITNESS WHEREOF the said party' -of the first part has caused
these presents to be executed in its name by its Board of County Commissioners
acting by the Vice -Mayor and the Deputy Clerk of saieBoard; the day
and year aforesaid.
