A RESOLUTION AMENDING RESOLUTION NO.
42309 ENTITLED "A RESOLUTION CLOSING
S.W. 5 STREET PROM S.W. 3 AVENUE TO THE
NORTHWESTERLY LIMITED ACCESS BOUNDARY
ON STATE ROAD NO. 9 AND CONVERTING SAME
TO A 50-FOOT PUBLIC UTILITY EASEMENT" TO
CORRECT THE 'LEGAL METES AND BOUNDS DE-
SCRIPTION THEREIN TO SPECIFY AN EASEMENT
40.83 FEET IN WIDTH; CORRECTING THE
DESIGNATION FOR THE STATE ROAD FROM NO.
9 TO NO. 9A; AND CHANGING THE WORD "T-
TURNAROUND" TO READ "CUL-DE-SAC".
WHEREAS, the portion of S.W. 5 Street from S.W.
3 Avenue to the Northwesterly Limited Access Boundary
on State Road No. 9A (Interstate I-95) was closed by
Resolution No. 42309; and
WHEREAS, Resolution No. 42309 inadvertently referred
to the State Road as No. 9 and it should have been No.
9A and also the designation T-Turnaround should have
been cul-de-sac; and
WHEREAS, the Dade County Board of Public Instruc-
tion has prepared plans for construction of school
facilities under the elevated portion of I-95 at this
location and finds that, due to the location of certain
pillars supporting the elevated roadway, it is necessary
for a portion of one building to encroach into the ease-
ment; and
WHEREAS, upon investigation it was found that

reducing the width of the eastment to 40.83 feet
will be acceptable to the City and also to the Florida
Power and Light Company as the Company has waived ob-
jections to the building structure being close to
their 240 K.V. electric duct;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That Resolution No. 42309 passed and
adopted March 11, 1971 entitled "A RESOLUTION CLOSING
S.W. 5 STREET FROM S.W. 3 AVENUE TO THE NORTHWESTERLY
LIMITED ACCESS BOUNDARY ON STATE ROAD NO. 9 AND CON-
VERTING SAME TO A 50-FOOT PUBLIC UTILITY EASEMENT" be
and the same is hereby amended to revise the legal
metes and bounds description therein, to specify an
easement 40.83 feet in width instead of 50 feet, said
description being amended hereby to read as follows:
Begin at the northeast corner of
Block 37 South, A. L. KNOWLTON MAP
OF MIAMI, as recorded in Plat Book
B, at Page 41, of the Public Records
of Dade County, Florida; thence run
south 87°54'32" west along the north
boundary of said Block 37 for a
distance of 377.28 feet to the point
of intersection with the northeasterly
production of the northwesterly Limited
Access Boundary of State Road No. 9A;
thence run north 26°39'16" east for a
distance of 46.57 feet to the point of
intersection with a line 9.17 feet
southerly of, and parallel with, the
south boundary of Block 28 South of
said A. L. KNOWLPON MAP OF MIAMI;
thence run north 87°54'32" east
along said line being 9.17 feet
south of, and parallel with, the
south boundary of said Block 28 for
a distance of 354.77 feet to a point
of intersection with the southerly pro-
duction of the east boundary of said
Block 28 South; thence run south
02°14'32" east along said southerly
production of the east boundary of
said Block 28 South for a distance
of 40.83 feet to the Point of Begin-
ning.
Section 2. That Resolution No. 42309 be, and
it is hereby, further amended to correct the State
Road designation from No. 9 to No. 9A and to change
the word "T-Turnaround" to read "Cul-de-Sac".
