RESOLUTION NO. .7 372
A RESOLUTION AUTHORIZING THE DIRECTOR
OF FINANCE TO ACCEPT THE SUM OF $165.00
IN FULL AND COMPLETE SETTLEMENT OF THE
CLAIM OF THE CITY OF MIAMI AGAINST
PEARLINE BROWN AND BERTHA SMITH BRINSON,
AND AUTHORIZING THE CITY ATTORNEY TO
REQUEST AN ORDER OF DISMISSAL IN THE
SMALL CLAIMS COURT OF DADE Comm
FLORIDA.
WHEREAS, a claim has been filed by the City of Miami
against Pearline Brown and Bertha Smith Brinson, as a
result of a collision on May 18, 1969, at the Emergency
Room entrance of Jackson Memorial Hospital, Miami, Florida,
by an automobile owned by Pearline Brown and negligently
operated by Bertha Smith Brinson, damaging a City of Miami
owned fence; and
WHEREAS, prior to the filing of a Statement of Claim
in the Small Claims Court, in and for Dade County, Florida,
Pearline Brown reimbursed the City of Miami in the amount of
$140,00; and
WHEREAS, at the trial of this case on December 2, 1971,
it was discovered that the Defendants are both indigent and
therefore judgment proof; and
WHEREAS, after negotiation with the Defendants, they
agreed to pay the sum of $25,00, making a total of $165,00,
in full and complete settlement of the City of Miami's claim
against them; and
WHEREAS, the City Attorney of the City of Miami has
advised that it is in the best interest

NOW,, THEREFORE* BE IT RESOLVED BY THE COMMISSION OF
THE CITY OP MIAMI* FLORIDA:
Section 1. That the Director of Finance is hereby
authorized and directed to accept the sum of $165.00 in
full and complete settlement of the claim of the City of
Miami against Pearline Brown and Bertha Smith Brinson,
and authorizing the City Attorney to request an Order of
Dismissal in the Small Claims Court of Dade County* Florida.
