RESOLUTION NO.
A RESOLUTION ACCEPTING THE PLAT ENTITLED
AMENDED PLAT OF PALM BAY CLUB, A SUBDIVI-
SION IN THE CITY OF MIAMI, FLORIDA, AND
ACCEPTING THE DEDICATIONS SHOWN ON SAID
PLAT AND AUTHORIZING AND DIRECTING THE
ITY MANAGER AND CITY CLERK TO EXECUTE
PLAT.
WHEREA a on October 24, 1968, the Commission of
the City of Miami passed and adopted the following
listed resolutio - pertaining to the property platted:
(a) Reso ution No. 40065 vacating dedicated
walk- ay lying between Block 4, SOUTH
ELMIRA (6-151) and Tract "A" PALM BAY
CLUB, a to reestablish the area as a
pedestri• and utility easement.
(b) Resolution o. 40066 granting a variance
from Ordinan a No. 6871 in respect to
required set cks from property line for
proposed 64 un't apartment building.
(c) Resolution No. 4"067 granted a "condi-
tional use" as pr vided in Ordinance No.
6871, Article V, SItc. 16 (b) to permit
off-street parking \facilities for Palm
Bay Club on Lots 35 4id 37, ELMIRA
(B-162) .
(d) Resolution No. 40068 aut orized the
issuance of a special bui ding permit
in connection with the aboVementioned
resolutions;
and
WHEREAS, by authority of Resolution 68-323, adopted
November 18, 1968, the Planning and Zoning Board\f the
City of Miami recommended for adoption the plat ent tied

AMENDED PLAT OF PALM BAY CLUB; and
WHEREAS, on October 28, 1969, the Commission of
the City of Miami adopted Resolution No. 41073 re-
questing the City Manager to investigate allegations
of unlawful intended use of a fifteen -foot strip of
right-of-way in SOUTH ELMIRA subdivision by the Palm
Bay Club;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. The Plat entitled AMENDED PLAT OF PALM
BAY CLUB, being a replat of all of PALM°BAY CLUB, P.B.
29, P. 87; Lots 35 and 37 of ELMIRA, P.B. "B", P. 162;
all of Block 4 of SOUTH ELMIRA, P.B. 6, P. 151,
together with lands lying east of said Block 4; and a
portion of a tract of land lying west of Lot 1, Block 1,
of MC KAY SUBDIVISION, P.B. 75, P. 18; and portions of
Lots 1 and 2, Block 1, of said MC KAY SUBDIVISION; all
lying and being in Section 18, Township 53 South, Range
42 East, Miami, Dade County, Florida, which by reference
is made a part hereof as if fully incorporated herein,
and the dedications as shown thereon, together with all
existing and future plantings, trees and shrubbery on
said property, to the perpetual use of the public be,
and the same are, hereby accepted and confirmed by the
City of Miami, Florida.
Section 2. Except for the construction of those

improvements provided for in the Agreement entered
into between the Owner and the Director of the
Department of Public Works on behalf of the City
of Miami, Florida, dated January 9, 1969, the require-
ments of Chapter 54, Section 54-20, Code of the City
of Miami, Florida and State law as to improvements
to be made in subdivisions will hereby expressly be
waived.
Section 3. Of all other requirements of State
law concerning the posting of a Performance Bond for
the construction of improvements, that portion per-
taining to the maintenance of said improvements is
hereby expressly waived.
Section 4. The requirements of State law concern-
ing the showing of grades of rights -of -way on the Plat
are hereby expressly waived.
Section 5. The City Manager and the City Clerk,
both of the City of Miami, Florida, are hereby author-
ized and directed to execute the Plat.
