A RESOLUTION ACCEPTING THE DECEMBER 7, 1973 COVENANT
TO RUN WITH THE LAND FROM THE BANK OF MIAMI; AND
DIRECTING THE PROPER OFFICIAL OF THE CITY OF MIAMI
TO RECORD SAID COVENANT IN THE PUBLIC RECORDS OF
DADE COUNTY, FLORIDA
WHEREAS, the Bank of Miami, fee owner of the building
at 100 East Flagler Street, requests to construct, install and
maintain a ventilation pit and salt water drainage well under
the sidewalk area on the east side of S. E. 1st Avenue 55 + feet
and 160 + feet, respectively, south of the center line of East
Flagler Street; and
WHEREAS, the Bank of Miami has executed and delivered to
the City of Miami a covenant for such undertaking, which covenant
provides the customary guarantees, protection and insurance for
the City's protection; and
WHEREAS, it is now in order for the City Commission to
accept the aforesaid covenant and to have it recorded in the Public
Records of Dade County, Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. That the December 7, 1973 covenant from The
Bank of Miami relating to the construction, operation and maintenance
of a ventilation pit and a salt water drainage well under the side-
walk area of its building at 100 East Flagler Street on the east
side of S. F. 1st Avenue 55 + feet and 160 + feet, respectively,
south of he center line of East Flagler Street be, and the same is
hereby, accepted, copy of said covenant being attached hereto and
by this reference made a part hereof.
Section 2. That the proper official of The City of Miami be,
and he is hereby, authorized and directed to record the aforesaid
covenant in the Public Records of Dade County, Florida.
