RESOLUTION NO.73-914
A RESOLUTION ACCEPTING THE PLAT ENTITLED
CULMER PARK SUBDIVISION NO. 1, A SUB—
DIVISION IN THE CITY OF MIAMI, FLORIDA;
ACCEPTING THE DEDICATIONS SHOWN ON SAID
PLAT; AND AUTHORIZING AND DIRECTING THE
CITY MANAGER AND CITY CLERK TO EXECUTE
THE PLAT.
WHEREAS, the City Planning and Zoning Board and the
Department of Public Works have recommended the acceptance
of the Plat; and
WHEREAS, on January 25, 1973, the City Commission
passed and adopted Resolution No. 73-57, closing for public
use that portion of N.W. 9th Street between N.W. 5th and
7th Avenues, and N.W. 6th Avenue between N.W. 8th and llth
Streets, in accordance with Tentative Plat No. 762-C
designated as CULMER PARK SUBDIVISION NO. 1; and
WHEREAS, as a courtesy to another governmental agency,
the Director of the Department of Public Works recommends
that the requirement of the City Code to post a Performance
Bond to guarantee the completion of subdivision improvements
be waived;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The Plat entitled CULMER PARK SUBDIVISION
NO. 1, being a replat of Blocks 11N, 29N, 30N, 31N, 32N and
a portion of Block 12N, all of "MAP OF MIAMI", Plat Book B,

Page 41, Section 37, Township 53 South, Range 41 East,
Miami, Dade County, Florida, which by reference is made
a part hereof as if fully incorporated herein, and the
dedications as shown thereon together with all existing
and future plantings, trees and shrubbery on said property,
to the perpetual use of the public be, and the same are
hereby accepted and confirmed by the City of Miami, Florida.
Section 2. Except for the construction of those im-
provements provided for in the Agreement entered into between
the Owner and the Director of the Department of Public Works
on behalf of the City of Miami, Florida, the requirements of
Chapter 54, Section 54-20, Code of the City of Miami, Florida,
and State law as to improvements to be made in subdivisions
will hereby expressly be waived.
Section 3. That the requirements of Chapter 54, Section
54-20, the Code of the City of Miami, Florida, and State law
concerning the posting of a Performance Bond to guarantee the
construction of subdivision improvements are hereby waived.
Section 4. Of all other requirements of State law
concerning the posting of a Performance Bond for the con-
struction of improvements, that portion pertaining to the
maintenance of said improvements is hereby expressly waived.
Section 5. The requirements of State law concerning
the showing of grades of rights -of -way on the Plat are
hereby expressly waived.
