HomeMy WebLinkAboutR-73-08851 2 3 4 8 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 RHT/ec 11/6/73 RESOLUTION NO. 73`885 A RESOLUTION GRANTING A "CONDITIONAL USE", AS PROVIDED IN ORDINANCE NO, 6871, ARTICLE V, SECTION 1(6) (a) , TO PERMIT EDUCATIONAL AND SOCIAL CENTER TO BE CONSTRUCTED ON TRACT "C" - "CULMER PARK SUBDIVISION #1" - TENTATIVE PLAT #762-C, LOCATED AT THE N. E. CORNER N. W. 7TH AVENUE AND BTH STREET, IN CONJUNCTION WITH HUD PROJECT #5-49, ZONED C-4 (GENERAL COMMERCIAL) DISTRICT AND C--5 (LIBERAL COMMERCIAL) DISTRICT, SUBJECT TO LANDSCAPE APPROVAL BY THE PLANNING DEPARTMENT, PROPOSED TO BE REZONED R-4 (MEDIUM DENSITY MULTIPLE) DISTRICT. WHEREAS, The City Planning and Zoning Board of the City of Miami, at its meeting held on October 15, 1973, passed and adopted by a 9 to 0 vote its Resolution no. 73-214, as hereinafter set forth; and this Commission deems it advisable to the public convience and welfare and finds that the use will not be detrimental or injurious to the character or the development of the immediate neighborhood; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the application for a "conditional use" as provided in Ordinance No. 6871, Article V, Section 1(6)(a), to permit Educational and Social Center to be constructed on Tract "C" - "CULMER PARK SUBDIVISION #1" - Tentative Plat #762-C, located at the N. E. corner of N. W. 7th Avenue and 8th Street, in conjunction with HUD project #5-49, zoned C-4 (General Commercial) District and C-5 (Liberal Commercial) District, subject to landscape approval by the Planning Department, proposed to be rezoned R-4 (Medium Density Multiple) District, be and the same is hereby granted. This conditional use shall become null and void unless the use is commenced within six months of the effective date of this resolution. Upon application, the City Manager may, after review and determination that substantial progress has been aohieved by the applicant in terms of project planning, extend the expiration date of the conditional use for an additional period of time not to exceed one (1) year. Said extension request shall be filed with the City Manager two (2) weeks prior to the expiration date of the initial six (6) months effective period of the conditional use.
