A RESOLUTION AUTHORIZING AND DIRECTING THE CITY
CLERK OF THE CITY OF MIAMI TO OFFER FOR SALE TO
THE HIGHEST AND BEST BIDDER AFTER NOTICE IS
PUBLISHED ONCE A WEEK FOR AT LEAST TWO WEEKS IN
A NEWSPAPER OF GENERAL CIRCULATION IN THE CITY
OF MIAMI THE PORTION OF BROOKER STREET NORTH OF
KUMQUAT AVENUE, THE SAME BEING MORE PARTICULARLY
DESCRIBED AS "THE E. 1/2 OF LOT 1, POMONA (16-75)."
WHEREAS, on January 25, 1926, a Quit Claim Deed was executed
by the Pomona Properties, Inc., conveying to The City of Miami
the E. 1/2 of Lots 1, 26, 27 and 52 of POMONA (16-75) for street
purposes and reserving to said Pomona Properties, Inc. the
reversion and reversions whenever closed or discontinued in
accordance with law; and
WHEREAS, the reversionary interests of the Pomona Properties,
Inc. in this dedicated right of way has now been cancelled under
the provisions of Florida Statute 177.085 (Chapter 72-257) enacted
July 1, 1972; and
WHEREAS, the owners of the property located on the easterly
and westerly side of the portion of aforementioned right of way
lying north of Kumquat Avenue have requested that it be disposed
of to prevent vandalism, parking of abandoned cars, the dumping of
trash and garbage and other uses that are detrimental to occupants
of the abutting properties; and
WHEREAS, all the utility companies have indicated that they
would interpose no objection to the sale of the aforementioned
right of way provided that the east six feet and the north six
feet shall be retained as public utility easements; and
WHEREAS, the Department of Public Works has investigated this
property and has determined that it is not needed for municipal
use, and recommends that it be disposed under the provisions of
Chapter 70-387, Florida Statutes;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. That the City Clerk of The City of Miami be,
and he is hereby, authorized and directed to offer for sale to the
highest and best bidder, after notice is published once a week
for
at least two weeks in a newspaper of general circulation in
the City of Miami, the following described real property:
The east one-half (E. 1/2) of Lot one (1) POMONA,
as recorded in Plat Book 16, at Page 75, of the
Public Records of Dade County, Florida, subject
to the following conditions:
1. The east six (6) feet and the north six (6)
feet of the above described property will be
retained as a permanent easement for the
purpose of installing, maintaining and
repairing public utilities now in place or
to be placed in the above described property.
2. The successful bidder shall agree not to
erect or cause to be erected any permanent
buildings, walls or structures within the
limits of this easement.
3. The successful bidder may use this easement
as yard area and may at his own risk plant
trees, shrubs and grass therein and bear the
cost of its removal and replacement in the
event its removal is necessary.
Section 2. That said advertisement is to call for bids for
purchase of the above described real property and specify the
terms of purchase.
