"
A RESOLUTION STATING THE INTENT OF THE CITY
COMMISSION TO ACCEPT THE PUBLIC DEDICATION OF
CERTAIN MINIMUM TWENTY -FOOT MIAMI RIVER'.
PEDESTRIAN WALKWAY EASEMENTS; APPROVE IN
PRINCIPLE THE CONCEPT OF THE ESTABLISHMENT AND
OPERATION OF A BOAT RESTAURANT ADJACENT TO
PEDESTRIAL WALKWAY; AND AGREE TO ACCEPT THE
RESPONSIBILITY FOR THE MAINTENANCE OF THE
PEDESTRIAN WALKWAY.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. That it is the intent of the City
Commission to accept the public dedication of certain twenty -
foot width Miami River pedestrian walkway easements for the
construction of a public landscaped walkway along the edge of the
north bank of the Miami River as may be recommended by the City
Manager.
Section 2. The City Commission approves in principle
the concept of the establishment and operation of a boat restaurant
adjacent to a twenty -foot wide publicly dedicated River pedestrian
walkway easement east of N.E. 2nd Avenue (Brickell) Bridge at the
Dupont Plaza Center property subject to such boat restaurant
meeting all building and fire code provisions and the obtaining of
all governmental permits as may be required by the City of Miami,
Dade County, State of Florida and the United States of America.
Section 3. The City Commission authorizes the proper City
Officials to accept the responsibility for the maintenance of the
Miami River Pedestrian Walkway as well as the cost of operation of
walkway lighting and emergency telephone service when said walkway
is constructed in accordance with concepts, plans, specifications
and construction bids and awards approved in writing by the City
