W. 22ND COURT, FROM R-3 (LOW DENSITY MULTIPLE) TO I-1 (LIGHT INDUSTRIAL) DISTRICT. WHEREAS, the Planning and Zoning Board of the City of Miami, at its meeting held on June 25, 1973, passed and adopted by a 9 to 0 vote its Resolution No. 73-145 recommending granting a change in zoning classification, as hereinafter set forth; and WHEREAS, it is deemed advisable in the best interest of the general welfare of the City of Miami and its inhabitants to grant a change in zoning classification, as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That Ordinance No. 6871, the Comprehensive Zoning Ordinance for the City of Miami, be and the same is hereby amended by changing the zoning classification for Lots 10, 11, 12 and 13, Block 8, WINTER GARDEN 1ST AMD (5-22), located at 2035 N. W. 22nd Court, from R-3 (Low Density Multiple) to I-1 (Light Industrial) District; and by making the necessary changes in the zoning district map made a part of said Ordinance No. 6871, by reference and description in Article III, Section 2, thereof. Section 2. That all laws, or parts of laws, in conflict herewith, be and the same are hereby repealed insofar as the above described land is involved. -1- Section 3. It is declared to be the legislative intent of this body that if any section, subsection, sentence. phrase, or provision of this Ordinance is held invalid, the remainder of the Ordinance shall not be effected. PLANNING DEPARTMENT RECOMMENDATION: "APPROVAL" The subject property should be rezoned from R-3 (Low Density Multiple) zoning classification to that of I-1 (Light Indust- tial) classification in that it exists at present as a spot residential zone within a much larger, well defined and well established area of light industrial zoning. The subject property was part of a larger application for rezoning from I-1 to R-3, passed and adopted in May of 1964. Since that time the character of development and redevelopment in the area has overwhelmingly been that of industrial usage. It is also recommended that a public hearing be initiated for a zoning change on the remaining R-3 zoned property north of the subject property. This property is composed of three (3) lots currently in apartment use. Mr. Martinez: Those here to testify on this, would you please stand up to be sworn in. State your name and address for the Record. Mr. Vazquez: My name is Oscar Vazquez, my address is 7835 N. W. 55 Street. I would like to change that zoning on this lot, to build some warehouses. If that is all you have to say at this time, we will close the public nearing. Discussion from the Board Members? If not, Mrs. Fernandez, this is in your district. Mrs. Fernandez: The recommendation of the Planning Department is to approve. Mr. Silverman: Mrs. Fernandez, the recommendation on that for the request -- Mrs. Fernandez: I realize that, and I want to ask the Depart - the Planning Department when they are planning - Mr. Silverman: We have to initiate the hearing. Mrs. Fernandez: We have to ask the public to initiate the study of this area, according to the recommendation of the Planning Department,for cnanging of this zoning, from R-3 to I-1, and I want then, to move to initiate a public hearing, for that purpose. Mr. Martinez: You are making a motion to initiate a public hearing, to study the area. Mr. Simpson: As I understand it, Mr. Chairman, it is not to study the area, supposedly, the Planning Department has already studied the area, and their request that a public hearing be initiated for a zoning change, that's what it says. I building vintage, changing would like to inform the Board, that there is an apartment on the remaining portion of the R-3, that is of fairly new as I recall, I think '65 - 64' or '65, will be considering an existing use of an apartment building, to an I-1 zone. Mr. Martinez: In other words, Grandfather situation. we're going to have another Mr. Simpson: The map will look... Mr. Martinez: And you want to initiate the hearing. Mrs. Fernandez: I say, initiate the public hearing, and see what is the reaction of the present owners, of this area. Mr. Martinez: Okay, is there a second to the motion? Mr. Alfonso: Second.
