AN ORDINANCE AMENDING ORDINANCE NO. 6871,
THE COMPREHENSIVE ZONING ORDINANCE FOR
THE CITY OF MIAMI, BY CHANGING THE ZONING
CLASSIFICATION FOR LOTS 10, 11, 12 AND 13,
BLOCK 8, WINTER GARDEN 1ST AMD (5-22),
LOCATED AT 2035 N. W. 22ND COURT, FROM
R-3 (LOW DENSITY MULTIPLE) TO I-1 (LIGHT
INDUSTRIAL) DISTRICT.
WHEREAS, the Planning and Zoning Board of the City
of Miami, at its meeting held on June 25, 1973, passed and
adopted by a 9 to 0 vote its Resolution No. 73-145 recommending
granting a change in zoning classification, as hereinafter
set forth; and
WHEREAS, it is deemed advisable in the best interest
of the general welfare of the City of Miami and its inhabitants
to grant a change in zoning classification, as hereinafter
set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That Ordinance No. 6871, the Comprehensive
Zoning Ordinance for the City of Miami, be and the same is
hereby amended by changing the zoning classification for
Lots 10, 11, 12 and 13, Block 8, WINTER GARDEN 1ST AMD (5-22),
located at 2035 N. W. 22nd Court, from R-3 (Low Density
Multiple) to I-1 (Light Industrial) District; and by making
the necessary changes in the zoning district map made a part
of said Ordinance No. 6871, by reference and description in
Article III, Section 2, thereof.
Section 2. That all laws, or parts of laws, in
conflict herewith, be and the same are hereby repealed insofar
as the above described land is involved.

Section 3. It is declared to be the legislative
intent of this body that if any section, subsection, sentence.
phrase, or provision of this Ordinance is held invalid, the
remainder of the Ordinance shall not be effected.
PASSED on first reading by title only this 13th day
of September, 1973.
PASSED AND ADOPTED on second and final reading by
title only this 26th day of September, 1973.

PLANNING DEPARTMENT RECOMMENDATION: "APPROVAL"
The subject property should be rezoned from R-3 (Low Density
Multiple) zoning classification to that of I-1 (Light Indust-
tial) classification in that it exists at present as a spot
residential zone within a much larger, well defined and well
established area of light industrial zoning. The subject
property was part of a larger application for rezoning from
I-1 to R-3, passed and adopted in May of 1964. Since that
time the character of development and redevelopment in the
area has overwhelmingly been that of industrial usage. It is
also recommended that a public hearing be initiated for a zoning
change on the remaining R-3 zoned property north of the subject
property. This property is composed of three (3) lots currently
in apartment use.
Mr. Martinez: Those here to testify on this, would you please
stand up to be sworn in. State your name and address for the Record.
Mr. Vazquez: My name is Oscar Vazquez, my address is 7835 N. W.
55 Street.
I would like to change that zoning on this lot, to build some
warehouses.
Mr. Martinez: To light industrial. Is there anyone in oppo-
sition to this item? Anyone in opposition to this item? No. Okay.
If that is all you have to say at this time, we will close the public
nearing. Discussion from the Board Members? If not, Mrs. Fernandez,
this is in your district.
Mrs. Fernandez: I want to ask the applicant, if he has read
the recommendation of the Planning Department?
Mr. Vazquez: No, I have not.
Mrs. Fernandez: The recommendation of the Planning Department
is to approve. "The subject property should be rezoned from an R-3
Low Density Multiple zoning classification to that of I-1 Light Indus-
trial classification . . ."
And, I want to ask you if you own some other properties within
this R-3 area?
Mr. Vazquez: Yes, I do. I own Lots 11 and 12, on 23rd Avenue
there, in Block 7. Lot 11 and 12.
Rev. Johnson: Lots 11 and 12.
Mr. Vazques: In those lots there, the yellow lots, 10, 11, 12,
and 13, what they have there is a garbage pile, and some old houses
almost coming down.
Mrs. Fernandez: Well, Mr. Chairman, I am ready to move for
approval for the change of Zoning Classification from R-3 Low Density
Multiple to I-1 Light Industrial.

Mr. Simpson: As I understand it, Mr. Chairman, it is not to
study the area, supposedly, the Planning Department has already studied
the area, and their request that a public hearing be initiated for a
zoning change, that's what it says.
