BAYSEORE DRIVE, WITH SIDE: SETBACK FOR
TOWER C2 35' (50' REQUIRED); SUBJECT TO
SITE PLAN APPROVAL BY THE PLANNING DEPART-
MENT AND A FRONT SETBACK OF 41' FROM THE
PROPERTY LINE TO ANY PORTION OF THE BUILD-
ING INCLUDING BALCONIES, ZONED R-5 (LOW -
DENSITY MULTIPLE) DISTRICT
WHEREAS, the 'City Planning and Zoning Board of
the City of iiiami, at its meeting on July 23, 1973, passed
and adopted by a 7 to 0 vote its Resolution No. 73-168, recommend-
ing granting a variance from Ordinance No. 6871, Article X,
Sections 6 and 3 (2), as hereinafter set forth; and this
Commission deems it advisable in the interest of the general
welfare of the City of Miami to grant this variance requested
on the ground that due to peculiar circumstances affecting this
parcel of land practical difficulties and unnecessary hardships
would impair the owner's rights to some reasonable use of the
property under a R-5 (High Density Multiple) District;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, , FLORIDA:
Section 1. That the application for a variance
from Ordinance No. 6671, Article X, Sections 6 and 3 (2),
to permit constrLction of 80-unit apartment building on
Tentative Plat T878-A, "3ELLA BAHIA SUBDIVISION", located
at approximately 1440 South Bayshore Drive, with side setback
for tower of 35' (50' required), subject to site plan approval
by the Planning Department, and a front setback of 41' from
the proerty line to any portion of the building including
balconies, zoned R-5 (High Density Multiple), District, be and

Sction 2. This variance shall become null and
void unless the use is commenced within six months of the
effective date of this Resolution. Extension may be granted
by the City :tanager pursuant to• the provisions of Article
XXXI, Section 4, of Ordinance No. 6871.
