WHEREAS, the Cy L ��� Planning and Zoning Board of the
City of Mia^1i, at its meeting held on Septe„iaer 10, 1973,
passed and adopted by a 7 to 2 vote its 1c.so. ution No. 73-179,
recommending granting a variance .from Ordinance No. 6871,
Article ?C:III,Section 3 (3), as hereinafter set forth; and
this Commission deems it advisable in the interest of the
general welfare of the City of Miami to grant this variance
requested on the ground that due to peculiar circumstances
affecting this parcel of land practical difficulties and un-
necessary hardships would impair the owner's rights to some
reasonable use of the property under C-2 (Community Commercial)
and R-1 (One -Family) Districts;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI , FLORIDA:
Section 1. That the application for a variance
from Ordinance :.o. 6871, Articli. XXIII, Section 3 (3) , to
permit construction of grandstand addition to Flagler Dog
Track
located on Tract "A", AIRLINE CENTER AMD (33-77) ,
and Lai?LATTER TRACT at 401 N.W. 36th Court, waiving the •
interior landscaping of th,-, parking lot for a period of one
(1) year, but requiring additional landscaping in 10' wide area
:c entire Tract bringing up to code those parkin

subject to the iTproval of the Planning.',cpartment, site
zoned C-2 (Community Commercial) District and R-1 (One Family)
District, be and the same is hereby granted, subject to the
following conditions:
1. New landscaping in 10' wide area surrounding
entire Tract; vision clearance standards are to be met
in corners of the south fenced area.
2. Interior landscape areas around all light standards;
details of such landscape areas shall meet the requirements
set forth in the off-street parking regulations.
3. Periphery landscaping around those parking lots
located east of N.W. 37th Avenue used for Dog Track parking;
lighting standards for those lots shall be so placed and
designed that it will throw illumination toward 37th Avenue
and not toward the surrounding low density residential area.
4. Site plan approval by the Planning Department
of all landscape design and materials within thirty (30) days.
3. :.11 work shall be accomplished within one hundred
and eighty (180) days, zoned C-2 (Community Commercial) and
(C:i t�.:i1y) District.
Section 2. This variance shall become null and
void unless the use is commenced within six months of the
effective sate of this Resolution. Extension may be granted
by the City Manager pursuant to the. provisions of Article XXXI,
Section 4, of Ordinance No. 6871.
PASSED AND ADOPTED this 26th day of September,1973.

Applicant: Bella Bahia Development
The Miami Planning Board, at its meeting of July 23, 1973, Item
#4 (a), following an advertised Hearing, adopted Resolution No.
73-168 by a 7 to 0 vote (2 members absent) recommending Variance
from Ordinance No. 6871, ARTICLE X, Section 6 and 3 (2), to per-
mit construction of 80-unit apartment building on Tentative Plat
#878-A, "BELLA BAHIA SUBDIVISION", located at approximately
1440 South Bayshore Drive, with side setback for tower of 40'
(50' required); subject to site plan approval by the Planning
Department; zoned R-5 (High Density Multiple).
One objection was received in the mail.
A RESOLUTION to provide for this Variance has been prepared by
the City Attorney's office and submitted for consideration of
the City Commission.

vacation and closure of the northeast -southwest Alley between
Lots 35, 58 and 59, Block 2, POINT VIEW AMD (2-93), located at
approximately 1440 SouLh Bayshore Drive, all in accordance with
Tentative Plat #878-A, "BELLA BAHIA SUBDIVISION".
One objection was received in the mail.
A RESOLUTION to provide for this vacation and Alley closure has
been prepared by the City Attorney's office and submitted for
consideration of the City Commission.
