A RESOLUTION ADOPTING RULES OF PROCEDURE FOR
THE ELECTION BY POLICEMEN AND FIREMEN, WED ARE
RETIREMENT SYSTEM MEMBERS, OF ONE MEMBER OF THE
RETIREMENT BOARD OF THE MIAMI CITY EMPLOYEES'
RETIREMENT SYSTEM FOR A TERM OF TWO YEARS IN
ACCORDANCE WITH ORDINANCE NO. 2230 AS AMENDED,
PROVIDING FOR THE NOMINATION OF CANDIDATES,
PROVIDING FOR SAID ELECTION, PROVIDING FOR
RUN-OFF ELECTION IF NECESSARY, PRESCRIBING
FORM OF BALLOT, PROVIDING FOR CANVASSING AND
DECLARATION OF RESULT OF SAID ELECTION
WHEREAS, under Ordinance No. 2230 as amended,
it is provided that one member of the Retirement Board
who shall be a member of the system, shall be elected
for a term of two years by the '.tetirement System members
who are Policemen and Firemen;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MI AMI , FLORIDA:
Section 1. That the following rules of procedure
for said election are hereby established:
a. An employee to be eligible for election or to vote
must be a member of the Miami City Employees' Retirement
System and classified as a policeman or fireman as defined
under said system.
b. A ballot shall be prepared by the City Clerk with
the names of the candidates placed thereon. No candidate
may have his or her name placed upon the ballot except that
a petition, obtained from the City Clerk's office, be signed
in his or her behalf, by at least TEN members of the Retire-
ment System classified as policemen or firemen, filed with
the City Clerk, together with an acceptance signed by the
candidate, on a form provided by the City Clerk, not later
than 5:00 P.M. on October 19, 1973. No employee shall sign
petitions for more than one candidate.
c. The election is hereby set for October 26, 1973,
between the hours of 8:00 A.M. and 5:00 P.M. The places
designated for said election are: POLICE ROLL CALL ROOM
Municipal Justice Bldg., and FIRE DEPARTMENT GARAGE,
1151 N.W. 7 Street. H.D. SOUTHERN, City Clerk, is hereby
appointed to conduct said election and determine eligibility
of each person presenting himself to vote by comparison
of his signature with the Retirement System application
of said person, and is hereby authorized to appoint such
assistants as he may deem necessary to facilitate the holding
of said election.
d. In the event that no candidate receives a majority
of the votes cast, there shall be a run-off election between
' the two candidates receiving the highest number of votes,
which run-off election, if necessary, will be held on
November 2,1973, at the polling places set forth in paragraph C.
above.
e. The following five members of the Retirement
Board of the Miami City Employees' Retirement System:
Paul W. Andrews, W.R. Bailey, Ray Braziel, Ralph Parks
and Robert Paulk, are hereby appointed an "Election Board"
to supervise the election and canvass the returns with
instructions to certify the results to the City Clerk within
twenty-four hours after such election. The City Clerk shall
file the certificate of said election with the City Commission
at its first regular meeting thereafter. The City Commission
at said meeting shall by resolution declare the candidate
elected who shall have received the greatest number of votes
cast. A tie between two candidates shall be decided by lot
under the direction of the City Manager.
f. The official Ballot to be used in said election shall
be in substantially the following form:

g. Each Policeman or Fireman who is a member of the Miami City
Employees' Retirement System, as provided by Ordinance No. 2230 as
amended, shall be entitled to vote for one candidate providing he
present himself personally at the time and place designated for such
election. Each such member shall be excused by his superior a suffi-
cient time to cast his or her vote.
h. Upon confimation by the City Commission, the person elected
hereunder shall take office on November 22, 1973 upon taking the
oath of office therefor, and his or her term of office shall expire
two years from said date.
Section 2. That all resolutions or parts thereof in conflict
herewith be, and the same are hereby rescinded.
