A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO
HIRE THE LAW FIRM OF SAGER & BURNS, AT NO
ATTORNEYS FEES TO THE CITY OF MIAMI, TO PROCEED
WITH THE, FILING OF ANTI-TRUST LITIGATION AGAINST
THE PRODUCERS OF ELECTRIC LAMPS, ETC.
WHEREAS, the City Attorney has advised the City Commission
that there is an opportunity for the filing of an anti-trust action
against companies producing electric lamps, etc.; and
WHEREAS, the City Attorney has recommended that the law
firm of Sager & Burns, who have been successful for municipalities
and county governments in other anti-truot litigation, and who are
in the process of proceeding with this litigation be hired; and
WHEREAS, the City Attorney has advised the City Commission
that this type of litigation is carried out at no cost for
attorneys fees to the City of Miami inasmuch as if the attorneys are
successful the Federal courts award attorneys fees to be paid
by the aefendan ce,
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. That based upon the recommendation of the
City Attorney, the City Attorney is authorized to retain the law firm
of Sager & Burns to file a law suit, i.e. anti-trust action agains„_
the manufacturers of electric lamps, etc. at no attorneys fees to the
City.
