Home My WebLink AboutR-26-0199City of Miami Resolution R-26-0199 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 19109 Final Action Date: 4/23/2026 A RESOLUTION OF THE MIAMI CITY COMMISSION, AUTHORIZING THE CITY MANAGER TO ALLOCATE THREE MILLION AND 00/100 DOLLARS ($3,000,000.00) PURSUANT TO SECTION 62-642 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), UPON THE CITY MANAGER'S RECOMMENDATION, FROM THE PUBLIC BENEFITS TRUST FUND, ACCOUNT NO. 10095, TO THE AFFORDABLE HOUSING TRUST FUND, ACCOUNT NO. 14008.910101.4810000.0000.00000; APPROPRIATING IN AN AMOUNT NOT TO EXCEED THREE MILLION AND 00/100 DOLLARS ($3,000,000.00) FROM THE AFFORDABLE HOUSING TRUST FUND TO BE USED FOR THE REDEVELOPMENT OF THE PROPERTY LOCATED AT 7001 SOUTHWEST 4TH STREET, MIAMI, FLORIDA, AND OTHER ELIGIBLE SITES, FOR AFFORDABLE OR WORKFORCE HOUSING AND RELATED PUBLIC BENEFITS, INCLUDING BUT NOT LIMITED TO MOBILITY, OPEN SPACE, AND INFRASTRUCTURE IMPROVEMENTS THAT MAY SUPPORT CONNECTIVITY TO THE LUDLAM TRAIL CORRIDOR OR OTHER REGIONAL FACILITIES, SUBJECT TO COORDINATION WITH MIAMI-DADE COUNTY, AS APPLICABLE, AND CONSISTENT WITH THE PRIORITIES AND OPERATIONAL OBJECTIVES OF MIAMI-DADE COUNTY PUBLIC SCHOOLS (MDCPS), SUBJECT TO COMPLIANCE WITH THE CITY'S DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT GUIDELINES, APPLICABLE PROCUREMENT PROCESSES, THE RECEIPT BY THE CITY MANAGER OF THE WRITTEN APPROVAL OF THE PROJECT(S) BY THE CITY'S HOUSING AND COMMERCIAL LOAN COMMITTEE ("HCLC") AND SUBJECT TO THE TERMS, CONDITIONS, AND RESTRICTIONS CONTAINED IN SUCH APPROVAL(S), AND ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS FOR SAID PURPOSE; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. SPONSOR(S): Commissioner Ralph "Rafael" Rosado WHEREAS, Section 62-642 of the Code of the City of Miami, Florida, as amended, ("City Code") established a trust fund entitled the "Public Benefits Trust Fund," in order to collect the cash contributions made pursuant to Ordinance No. 13114, the Zoning Code of the City of Miami, Florida, as amended ("Miami 21 Code"), to supplement affordable/workforce housing, public parks and open space, and green building certification shortfalls; and WHEREAS, Section 62-642 of the City Code further provides that the City Commission, upon the manager's recommendation, shall annually allocate funds collected; and City of Miami Page 1 of 3 File ID: 19109 (Revision: A) Printed On: 7/31/2026 File ID: 19109 Enactment Number: R-26-0199 WHEREAS, Section 62-642 of the City Code additionally indicates that all cash contributions allocated by the City Commission to support affordable/workforce housing shall be deposited in the Affordable Housing Trust Fund for expenditures pursuant to the guidelines adopted by the City Commission; and all cash contributions allocated by the City Commission to support parks and open space shall be deposited in the Parks and Open Space Trust Fund to be expended in accordance with the guidelines outlined therein; and WHEREAS, the property located at 7001 Southwest 4th Street, Miami, Florida ("Property"), owned by Miami -Dade County Public Schools ("MDCPS"), and other similarly situated publicly owned or controlled sites, present opportunities for redevelopment to support affordable or workforce housing and related public benefits, subject to applicable approvals and procurement processes; and WHEREAS, redevelopment of the Property and other eligible sites is part of the City of Miami's ("City") overall effort to address the need for affordable and workforce housing and to support community -serving infrastructure and public benefits; and WHEREAS, funds in an amount not to exceed Three Million and 00/100 Dollars ($3,000,000.00) are to be allocated from the Public Benefits Trust Fund to the Affordable Housing Trust Fund; and WHEREAS, funds in an amount not to exceed Three Million and 00/100 Dollars ($3,000,000.00) are to be appropriated from the Affordable Housing Trust Fund to support the redevelopment of the Property and other eligible sites for affordable or workforce housing and related public benefits, subject to affordability requirements, applicable approvals, and procurement processes; and WHEREAS, such redevelopment opportunities may include, but are not limited to, modernization of existing facilities and improvements to mobility, open space, and infrastructure that enhance connectivity to surrounding neighborhoods and regional assets, including the Ludlam Trail corridor, as applicable and in coordination with Miami -Dade County; and WHEREAS, the City seeks to support redevelopment efforts that are consistent with the priorities and operational objectives of MDCPS while advancing affordable housing goals; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Subject to the receipt by the City Manager of the HCD/HCLC Approvals, which shall be consistent with the City Commission approval, the City Commission hereby authorizes and directs the City Manager to allocate funds in an amount not to exceed Three Million and 00/100 Dollars ($3,000,000.00) from the Public Benefits Trust Fund, Account No. 10095, to the Affordable Housing Trust Fund, Account No. 14008.910101.4810000.0000.00000. Section 3. City of Miami Page 2 of 3 File ID: 19109 (Revision: A) Printed on: 7/31/2026 File ID: 19109 Enactment Number: R-26-0199 which shall be consistent with the City Commission approval, the City Commission authorizes' the appropriation from the Affordable Housing Trust Fund in an amount not to exceed Three Million and 00/100 Dollars ($3,000,000.00) to be used for the redevelopment of the property located at 7001 Southwest 4th Street, Miami, Florida, and other eligible sites for affordable or workforce housing, provided that any such redevelopment complies with all terms and conditions to be set forth in the HCD/HCLC Approvals, which shall be consistent with the City Commission approval, and is further subject to applicable procurement requirements, affordability restrictions, and compliance with all federal, state, and local laws, and final approval by the City Commission. To the extent permissible under applicable laws and program guidelines, such housing may include preferences or targeted outreach for employees of MDCPS. Section 4. The City Manager is further authorized' to execute any and all documents necessary, all in a form acceptable to the City Attorney, for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ge = . If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
