HomeMy WebLinkAboutR-73-0688RHT/aeb 8/28/73 RESOLUTION NO. 7.3 "c i, A RESOLUTION AUTHORIZING THE CITY MANAGER TO PURCHASE BY NEGOTIATION IN LIEU OF CONDEMNATION PARCEL NO. 1537.1 OF THE CITY OF MIAMI EATON PARK EXPANSION PROJECT, AS DES- CRIBED HEREIN, FOR THE SUM OF $35,937.50 WITH THE CITY OF MIAMI ASSUMING THE RESPONSIBILITY FOR THE 1973 AD VALOREM TAXES DUE; AUTHORIZING THE CITY MANAGER TO REIMBURSE THE PROPERTY OWNERS FOR THE COST OF HAVING THE TWO BUILD- INGS ON THE PARCEL DEMOLISHED; AND ALLOCATING $40,000 FROM THE 1972 PARKS AND RECREATIONAL FACILITIES BOND FUND TO COVER THE COST AND OTHER MISCELLANEOUS EXPENSES PERTI- NENT TO THE ACQUISITION OF FEE SIMPLE TITLE TO THIS PROPERTY. WHEREAS, Parcel No. 1537.1 is a portion of the property proposed to be acquired for the expansion of Eaton Park; and WHEREAS, the citizens of the City of Miami approved the issuance of bonds to provide the funds to defray the cost of such property acquisition to provide for parks under the Parks for People Bond Program; and WHEREAS, the necessary monies for said acquisition are available in the 1972 Parks and Recreational Facilities Bond Fund; and WHEREAS, the owners of Parcel No. 1537.1 have by agreement dated August 21, 1973, offered to convey Fee Simple Title to this property to the City of Miami for $35,937.50 with the City of Miami assuming the responsi- bility for the 1973 ad valorem taxes due; and • WHEREAS, a part of the negotiated settlement, the owners of Parcel No. 1537.1 have requested repayment of the out-of-pocket expenses totaling $750 they incurred for demo- lition and removal of debris of the two buildings formerly located on this parcel; and WHEREAS, such expenses for the demolition of the buildings would have had to have been assumed by the City of Miami if the structures had not been demolished by the property owners; and WHEREAS, it is deemed in the best interest of the City of Miami, Florida, to acquire this property at this time through negotiated purchase. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI'. FLORIDA: Section 1. That the City Manager is authorized and directed to purchase Parcel No. 153r.1 of the Eaton Park expansion project for the sum of $35,937.50 with the City of Miami assuming the responsibility for the 1973 ad valorem taxes due, said parcel being described as follows: Lots 34 and 35 of White's Lemon City, as recorded in Plat Book B at Page 32 of the Public Records of Dade County, Florida, less the north four feet for street, plus the east ten feet, of a 20-foot wide alley abutting the west line of said Lot 35 and a strip of land lying south of and adjacent to and abutting said Lots 35 and 34 lying between the southerly extensions of the east line of Lot 34, and the west line of the east 1/2 of a 20-foot alley. Section 2. That the City Manager is authorized and directed to reimburse the property owners for the cost of having the two buildings on the parcel demolished. SECTION 3. That $40,000 is allocated from the 1972 Parks and Recreational Facilities Bond Fund to cover the cost of acquiring Fee Simple Title to the herein described parcel of land.
