HomeMy WebLinkAboutR-73-0680RESOLUTION NO. 73 ' G I A RESOLUTION RATIFYING THE ACTION TAKEN BY THE CITY MANAGER IN EXECUTING AND DELIVERING TO THE UNITED STATES OF AMERICA A TEMPORARY CONSTRUCTION EASEMENT AT THE OLD PORT OF MIAMI WHEREAS, by Public Law 90-483, adopted August 13, 1968, Congress authorized the construction of harbor improvements at the Miami Harbor; and WHEREAS, Dade County by Resolution No. R-1282-68 adopted November 4, 1968, assumed responsibility to provide without cost to the United States, all lands, rights of way and easements required for the deepening and widening of the entrance channel and turning basins at the Miami Harbor; and WHEREAS, the City of Miami owns and plans to develop the boat -slip areas in the "Old Port of Miami" as a park; and WHEREAS, the abovementioned boat -slips can be used as disposal areas for the dredged materials orininating from the Miami Harbor improvements project, thereby saving the City the expense of filling this area required for the Bayfront Park project; and WHEREAS, the disposal area will be entirely diked to retain the materials and weirs installed to control water quality; and WHEREAS, the United States Corps of Engineers has requested that the City grant a temporary construction easement covering the lands required for the above mentioned disposal site and also requested that such easement be provided forthwith, thus requiring the City Manager to execute the document prior to the next Commission meeting. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the Commission of the City of Miami does hereby approve the conveyance to the United States of America a temporary construction easement identified as Parcel CDA-11 at the "Old Port of Miami" for certain Miami Harbor improvements, 10 the exact location of said easement appearing in the form entitled "Temporary Easement" attached hereto and by this reference made a part hereof as if fully appearing herein. Section 2. That the Commission does hereby ratify and confirm the action taken by the City Manager and City Clerk in executing and delivering to the United States of America the aforesaid "Temporary Easement" at the Old Port of Miami under the date of September 5, 1973.
