HomeMy WebLinkAboutR-73-06611 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 RHT/cc 8/14/73 RESOLUTION NO. / 3" 46 A RESOLUTION GRANTING A "CONDITIONAL USE", AS PROVIDED IN ORDINANCE NO. 6871, ARTICLE XI-3, SECTION 1 (7) (e) , TO PERMIT 8000 SQUARE FOOT RESTAURANT ON PORTION OF LOT 1, BRICKELL POINT (8-34), LOCATED AT 444 BRICKELL AVENUE, SUBJECT TO OFF-STREET PARKING AGREEMENT WITH THE BUILDING DEPARTMENT; ZONED R-C-1 (RESIDENTIAL -OFFICE -COMMERCIAL) DISTRICT. • WHEREAS, the City Planning and Zoning Board of the City of Miami, at its meeting held on July 23, 1973, passed and adopted by a 7 to 0 vote its Resolution No. 73-171, recommending granting a "conditional use" as provided in Ordinance No. 6871, Article XI-3, Section 1(7) (e) , as hereinafter set forth; and this Commission deems it advisable to the public convenience and welfare and finds that the use will not be detrimental or injurious to the character or the development of the immediate neighborhood; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the application for a"conditional use" as provided in Ordinance No. 6871, Article XI-3, Section 1 (7) (e) , to permit 8000 square foot restaurant on portion of Lot 1, BRICKELL POINT (8-34), located at 444 Brickell Avenue, subject to off-street parking agreement with the Building Department, zoned R-C-1 (Residential - Office -Commercial) District, be and the same is hereby granted. 10 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 e Section 2. This conditional use shall become null and void unless the use is commenced within six months of the effective date of this resolution. Upon application, the City Manager may, after review and determination that substantial progress has been achieved by the applicant in terms of project planning, extend the expiration date of the conditional use for an additional period of time not to exceed one (1) year. Said extension request shall be filed with the City Manager two (2) weeks prior to the expiration date of the initial six (6) months effective period of the conditional use. Reese City of Miami, Florida Gentlemen: iami, Yloriba ,f July 31, 1973 • Re: "CONDITIONAL USE" - RECOMMENDED 444 Brickell Avenue Portion of Lot 1, BRICKELL POINT (8-34) Applicant: Rotunda Structures The Miami Planning Board, at'its meeting of July 23, 1973, Item 46, following an advertised Hearing, adopted Resolution No. 73-171 by a 7 to 0 vote (2 members absent), recommending "Conditional Use" as listed in Ordinance No. 6871, ARTICLE XI-3, Section 1 (7) (e), to permit 8000 square foot restaurant on Portion of Lot 1, BRICKELL POINT (8-34), located at 444 Brickell Avenue, subject to off-street parking agreement with the Building Department; zoned R-C-1 (Residential -Office -Commercial). No objections were received in the mail.
