A RESOLUTION MAKING PROVISIONS FOR HOLDING A NON-
PARTISAN PRIMARY ELECTION FOR THE NOMINATION OF
CANDIDATES FOR THE OFFICES OF MAYOR AND TWO COM-
MISSIONERS AND A LATER REGULAR MUNICIPAL ELECTION
UNLESS ALL OF SAID OFFICES HAVE BEEN FILLED IN THE
NON -PARTISAN PRIMARY ELECTION; PROVIDING FOR THE
REGISTRATION OF THE PERSONS QUALIFIED TO VOTE IN
SAID NON -PARTISAN PRIMARY ELECTION AND REGULAR
MUNICIPAL ELECTION; DESCRIBING THE REGISTRATION
BOOKS AND RECORDS MAINTAINED UNDER THE PROVISIONS
OF THE GENERAL LAWS OF FLORIDA AND CHAPTER 15 OF
THE CODE OF THE CITY OF MIAMI WHICH THE CITY HAS
ADOPTED AND. DESIRES TO USE FOR HOLDING SUCH NON-
PARTISAN PRIMARY ELECTION AND SUCH REGULAR MUNICIPAL
ELECTION; DESIGNATING AND APPOINTING THE CITY CLERK
AS THE OFFICIAL REPRESENTATIVE OF THE COMMISSION WITH
RESPECT TO THE USE OF SUCH REGISTRATION BOOKS AND
RECORDS; DIRECTING THE CITY CLERK TO GIVE NOTICE BY
PUBLICATION OF THE ADOPTION OF THIS RESOLUTION AND
OF THE PROVISIONS HEREOF; DIRECTING THE CITY CLERK
TO CAUSE A CERTIFIED COPY HEREOF TO BE. DELIVERED TO
THE SUPERVISOR OF ELECTIONS OF DADE COUNTY NOT LESS
THAN FORTY FIVE DAYS PRIOR TO THE DATE OF SUCH NON-
PARTISAN PRIMARY ELECTION.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. That, in accordance with the provisions of Section
8 of the City Charter (Chapter 10847, Laws of Florida, 1925, as
amended) a non -partisan primary election is hereby directed to be
held in the City of Miami at the polling places in the election
precincts as follows, to -wit:

from 7:00 o'clock A.M. until 7:00 o'clock P.M., Eastern Daylight
Time, on the 6th day of November, 1973, said date being the first
Tuesday after the first Monday in November, 1973, for the purpose
of nominating candidates for the offices of Mayor and two Commission-
ers of the City of Miami, to be voted upon at the Regular Municipal
election which is to be held on the second Tuesday after the first
Monday in November, 1973, as provided in said Section 8 of the City
Charter, unless in the Primary election a candidate receives a major-
ity vote in his group in which case he shall be elected to the office'
of the group for which he is a candidate.
Section 2. That, in the event a Regular Municipal election is
required to be held on November 13, 1973, then and in that event, a
Regular Municipal election is hereby directed to be held in the City
of Miami at the polling places in the election precincts as set
forth in Section 1 hereof from 7:00 o'clock A.M. until 7:00 o'clock
P.M., Eastern Daylight Time, on the 13th day of November, 1973, said
date being the second Tuesday after the first Monday in November,
1973, for the purpose of electing a Mayor and two Commissioners of
the City of Miami, unless a candidate receives a majority vote in
his particular group at the non -partisan. Primary election held on
November 6, 1973. The candidate who shall receive the highest num-
ber of votes in Group I shall serve as Mayor for a term of two (2)
years from 12:00 o'clock Noon of the date after the canvass of the
.vote -and the declaration of the results of said election; the
candidates who shall receive the highest number of votes in Groups
IV and V shall serve as Commissioners of the City for a period of
four (4) years from 12:00 o'clock Noon of the day after the canvass
of the vote and the declaration of the results of said election.

Section 3. That, in accordance with the provisions of the
general laws of Florida and Chapter 15 of the Code of the City of
Miami, persons qualified to vote in such Regular Municipal election,
who have not registered under the provisions of sai6 general laws
and Chapter 15 of the Code of the City of Miami, or who have trans-
ferred their legal residence from one voting precinct to another
voting precinct in the City of Miami, may register at a branch
office as approved by the Supervisor of Elections of Dade County,
Florida, which are located as follows, to -wit:

the same period each day thereafter to and including the 5th day of
October, 1973, and from 9:00 o'clock A.M. until 5:00 o'clock P.M.
on the 6th day of October, 1973. That, in addition to the above
times and places, the Supervisor of Elections shall make available
the mobile registration van for the purposes of registration of the
City of Miami residents for the herein described election, said
times and places of said registration to be determined and published
as required by law by the Supervisor of Elections. Said registration
shall be conducted by the Supervisor of Elections of Dade County,
Florida, under and subject to the provisions of the general laws of
Florida and Chapter 15 of the Code of the City of Miami, and he is
hereby authorized and empowered to do all things necessary and
proper for the purpose of conducting such registration in accordance

with the provisions of said general laws and Chapter 15 of the
Code of the City of Miami.
Section 4. That the City Clerk is hereby directed to publish
once in the Miami Herald and once in the Miami News, newspapers of
general circulation published in the City of Miami, a notice of
said non -partisan Primary election and registration in substantially
the following form, to -wit:

at which election the qualified electors participating therein will
vote for the nomination of candidates for the offices of Mayor and
two Commissioners of the City of Miami, to be voted upon at the
Regular Municipal election which is to be held on the second Tuesday
after the first Monday in November, 1973, unless in the Primary
election a candidate receives a majority vote in his group, in which
case he shall be elected to the office of the group for which he is
a candidate.
For the purpose of enabling persons to register who are qualified
to vote in said non -partisan Primary election to be held on November 6,
1973, and said Regular Municipal election to be held on November 13,
1973, if required, and who have not registered under the provisions
of the general laws of Florida and Chapter 15 of the Code of the
City of Miami or who have transferred their legal residence from
one voting precinct to another voting precinct in the City, they
may register at a permanent branch office as approved by Supervisor
of Elections of Dade County, Florida, which are located as follows,
to -wit:

That, in the event a Regular Municipal election is required
to be held on November 13, 1973, then the official ballot to be
used at such Regular Municipal election shall be in substantially
the same form as above, except that the heading of the ballot shall
be in substantially the following form, to -wit:

NOVEMBER 13, 1973
The City Clerk shall prepare the ballot so that the names of
the qualified candidates will appear on said ballot in alphabetical
order according to surname in each group; provided, however, that
the ballot and its preparation shall be such as to permit compliance
with the laws of the State of Florida with respect to the use of
mechanical voting machines.
Section 7. That the Supervisor of Elections of Dade County is
hereby informed and notified that the City of Miami desires to use
for holding such non -partisan Primary election on November 6, 1973
and such Regular Municipal election on November 13, 1973, the
registration cards described and called "official registration cards"
in the general laws of Florida and Chapter 15 of the Code of the City
of Miami, said registration cards to include the cards of all regis-
tered electors of the City of Miami in the precincts hereinbefore
designated.
Section 8. That H. D. Southern, the City Clerk of the City of
Miami, is hereby designated and appointed as the official representa-
tive of the Commission in all transactions with the Supervisor of
Elections of Dade County in relation to matters pertaining to the
use of such registration books and records for holding such non-
partisan Primary election and such Regular Municipal election.

Section 9. That the City Clerk is hereby authorized and
directed to cause a certified copy of this resolution to be
delivered to the Supervisor of Elections of Dade County not less
than forty-five (45) days prior to the date of such Primary
election.
Section 10. That in the event Dade County, Florida holds an
election on November 6, 1973, the same being the date of the City
of Miami non -partisan Primary election, then and in that event,
the City Clerk of the City of Miami is hereby directed and author-
ized to cooperate with the Supervisor of Elections of Dade County,
Florida in making use of the Dade County election facilities for
the purposes and in accordance with the provisions as herein
contained.
