A RESOLUTION GRANTING A "CONDITIONAL
USE" , AS PROVIDED IN ORDINANCE NO. 6871,
ARTICLE XV, SECTION 2(8)(a), TO PERMIT
PARKING LOT ON LOT 3, BLOCK 79N, MIAMI
(B-41), LOCATED AT 160 N. E. 5TH STREET,
SUBJECT TO A WALL ON THE EAST, SOUTH, AND
NORTH; WITH PLOT PLAN SUBJECT TO APPROVAL
OF THE PLANNING DEPARTMENT; SUBJECT TO
COMPLIANCE WITH LIGHTING REQUIREMENTS FOR
PARKING LOTS AS SET OUT IN ORDINANCE NO.
8115; SITE ZONED C-3 (CENTRAL COMMERCIAL)
DISTRICT.
WHEREAS, the City Planning and Zoning Board of
the City of Miami, at its meeting held on July 9, 1973,
passed and adopted by a 5 to 4 vote its Resolution No.
73-155 recommending granting a "conditional use" as
provided in Ordinance No. 6871, Article XV, Section 2(8)(a),
as hereinafter set forth; and this Commission deems it
advisable to the public convenience and welfare and finds
that the use will not be detrimental or injurious to the
character or the development of the immediate neighborhood;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a "conditional
use" as provided in Ordinance No. 6871, Article XV, Section
2(8)(a), to permit parking lot on Lot 3, Block 79N, MIAMI
(B-41), located at 160 N. E..5th Street, subject to a wall
on the east, south, and north; with plot plan subject to
approval of the Planning Department, site zoned C-3
(Central Commercial) District, be and the same is hereby
granted.

Section 2. The conditional use granted herein is
subject to compliance with the lighting requirements for
parking lots as set out in Ordinance No. 8115 of the City
of Miami, dated November 16, 1972.
Section 3. This conditional use shall become null
and void unless the use is commenced within six months of
the effective date of this Resolution. Upon application,
the City Manager may, after review and determination that
substantial progress has been achieved by the applicant
in terms of project planning, extend the expiration date
of the conditional use for an additional period. of time not
to exceed one (1) year. Said extension request shall be
filed with the City Manager two (2) weeks prior to the
expiration date of the initial six (6) months effective
period of the conditional use.

Gentlemen:
The Miami Planning Board, at its meeting of July 9, 1973, Item
#4, following an advertised Hearing, adopted Resolution No.
73-155 by a 5 to 4 vote recommending "Conditional Use" as list-
ed in Ordinance No. 6871, ARTICLE XV, Section 2 (8) (a), to
permit parking lot on Lot 3, Block 79N, MIAMI (B-41), located
at 160 N. E. 5th Street, subject to a wall on the east, south,
and north; with plot plan subject to approval of the Planning
Department; zoned C-3 (Central Commercial).
No objections were received in the mail.
A RESOLUTION to provide for this "Conditional Use" has been pre-
pared by the City Attorney's office and submitted for considera-
tion of the City Commission.
