RESOLUTION NO. 73. e-sPer°
A RESOLUTION AUTHORIZING AND DIRECTING THE CITY
MANAGER AND CITY CLERK TO EXECUTE AND DELIVER TO
METROPOLITAN DADE COUNTY, FLORIDA, A DISCLAIMER
AGREEMENT FOR THE PROPERTY DESCRIBED THEREIN.
WHEREAS, the Metropolitan Dade County, Florida, a
political subdivision of the State of Florida, has entered into
Eminent Domain Proceedings in the Circuit Court of the Eleventh
Judicial Circuit, in and for Dade County, Florida, Case No.
73-10712, Dade County vs. Jelli B. Corporation, and
WHEREAS, the City of Miami was listed as a Defendant in
these proceedings, and
WHEREAS, Lot 1, Block 1, GOLDEN GATE, Plat Book 21,
Page 46, Public Records of Dade County, Florida, is listed as
Parcel No. 42-2 in the above suit and the owners thereof are also
made Defendants, and
WHEREAS, a prior conveyance to the City of Miami has
resulted in a cloud on the South 2.11 feet of Parcel No. 42-2,
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The City Manager and City Clerk of the City
of Miami is hereby authorized to execute and deliver to Metropolitan
Dade County, Florida, a Disclaimer Agreement for the real property
more particularly described as follows:

Lot 1, Block 1, GOLDEN GATE, Plat Book 21,
Page 46, Public Records of Dade County, Florida,
designated as Parcel No. 42-2, in Case No. 73-10712,
in the Circuit Court of the Eleventh Judicial
Circuit, in and for Dade County, Florida,
said Disclaimer Agreement being attached hereto and by this
reference made a part hereof.
