A RESOLUTION GRANTING A "CONDITIONAL
USE", AS PROVIDED IN ORDINANCE NO. 6871,
ARTICLE XVI, SECTION 1 (37) (a) , TO PERMIT
AUTO PAINT SHOP ON LOTS 13 AND 14, BLOCK 2,
MELROSE HEIGHTS (11-17), LOCATED AT 2530
N. W. 36TH STREET, SUBJECT TO APPROVAL OF
THE SITE PLAN BY PLANNING DEPARTMENT, ZONED
C-4 (GENERAL COMMERCIAL) DISTRICT.

WHEREAS, The City Planning and Zoning Board of
the City of Miami, at its meeting held on July 9, 1973,
passed and adopted by a 9 to 0 vote its Resolution No.
73-158, recommending granting a "conditional use" as
provided in Ordinance No. 6871, Article XVI, Section
1 (37) (a) , as hereinafter set forth; and this Commission

deems it advisable to the public convenience and welfare and
19 finds that the use will not be detrimental or injurious
20 to the character or the development of the immediate
21 neighborhood;
22 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
23 OF THE CITY OF MIAMI, FLORIDA:
24 Section 1. That the application for a "conditional
25 use" as provided in Ordinance No. 6871, Article XVI,
26 Section 1 (37) (a) , to permit Auto Paint Shop on Lots 13 and
27 14, Block 2, MELROSE HEIGHTS (11-17) , located at 2530 N. W.
28 36th Street, subject to approval of the site plan by Planning
29 ,Department; zoned C-4 (General Commercial) District, be and
'30 the same is hereby granted.
31 Section 2. This conditional use shall become
null and void unless the use is commenced within six months
of the effective date of this Resolution. Upon application,

the City Manager may, after review and determination that
substantial progress has been achieved by the applicant
in terms of project planning, extend the expiration date
of the conditional use for an additional period of time
not to exceed one (1) year. Said extension request shall
be filed with the City Manager two (2) weeks prior to the
expiration date of the initial six (6) months effective
period of the conditional use.

The Miami Planning Board, at its meeting of July 9, 1973, Item
#7, following an advertised Hearing, adopted Resolution No.
by a 9 to 0 vote recommending "Conditional Use" as listed
"hnance No. 6871, ARTICLE XVI, Section 1 (37) (a), to permit
Auto'`•aint Shop on Lots 13 and 14, Block 2, MELROSE HEIGHTS (11-17),
located at 2530 N. W. 36th Street, subject to approval of the site
Plan by Planning Department; zoned C-4 (General Commercial).
Three objections were received in the mail.
A RESOLUTION to provide for this "Conditional Use" has been pre-
pared by the City Attorney's office and submitted for considera-
tion of the City Commission.
