AN ORDINANCE AMENDING ARTICLE VI OF CHAPTER 34 OF
THE CODE OF THE CITY OF MIAMI PROVIDING FOR THE
LIGHTING OF PUBLIC AND PRIVATE PARKING LOTS BY
CREATING NEW SECTION 34-63 THERETO; BY DELETING
PARAGRAPH (b) OF SECTION 34-63 ENTITLED "PARKING
LOT REVIEW BOARD" AND SUBSTITUTING A NEW PARAGRAPH
(b) AND ADDING PARAGRAPHS (c) , (d) , AND (e) SETTING
GUIDELINES FOR ADMINISTRATIVE HEARINGS: DECLARING THIS
ORDINANCE TO BE AN EMERGENCY MEASURE AND DISPENSING
WITH THE REQUIREMENT OF READING THE SAME ON TWO SEP-
ARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF
THE MEMBERS OF THE COMMISSION.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
Section 1. That Paragraph (b) of Section 34-63 entitled
"Parking Lot Review Board" is hereby deleted and a new Paragraph (b)
be substituted in lieu thereof to read as follows:
(b) Any person or persons who believe they are, jointly
or severally, aggrieved by any requirement as set forth in Sections
34-57 to 34-62, inclusive, thereto, may request in writing a hearing
before the Board for a Waiver of Compliance with the terms thereunder
and a hearing shall thereupon be scheduled within thirty (30) days,
to be held on a date designated by the Chairman of the Board.
Section 2. That Paragraphs (c), (d), and (e) to Section
34-63 entitled "Parking Lot Review Board" is hereby added thereto to
read as follows:
"(c) The Board, in considering the request for a Waiver of
Compliance may take into account the location of the area, the use
of the property and the existence of other available lighting or
other security measures commensurate with the intent and purpose of
this Chapter.
(d) The Board, at its first regular scheduled meeting,
shall adopt rules of practice and procedure to be followed by persons
applying for a Waiver of Compliance and also shall establish rules
of practice and procedure to be followed in the hearings held pur-
suant to the request for a Waiver of Compliance,
(e) That the decision of the hearing held before the
Parking Lot Review Board shall be the final administrative relief
available to the applicant and said decision shall be final in all
respects."
Section 3. This ordinance is hereby declared to be an
emergency measure on the ground of urgent public need for the preser-
vation of peace,.health, safety and property in the City of Miatni.
Section 4. The requirement of reading this ordinance on
two separate days is hereby dispensed with by a vote of not lea's
than four -fifths of the members of the Commission.
