Stipulation of Settlement
The Dolphins and Restaurant Associates have resolved their.differences
and the court case between the Dolphins, the City of Miami and
Restaurant Associates concerning the extension of the Agreement between
the City and Restaurant Associates has been settled.
You are now authorized to execute the Amendment No. 1 to the Agreement
dated August 4, 1967 between Restaurant Associates, Waldorf Associates
and the City pursuant to the Resolutions passed by the City Commission
which signing was prevented by this law suit. The assignment of the
Agreement between the Dolphins and Restaurant Associates cannot be valid
or binding on the City of Miami. "unless such assignment shall be in
writing and approved by the City of Miami", (Paragraph 15 of the Agreement)
Therefore, the Dolphins and Restaurant Associates should present the
Assignment and Management Agreement to the City Commission for approval
as required by the Agreement.
