HomeMy WebLinkAboutR-73-05493 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 .9 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 RHT/cc 6/27/73 RESOLUTION NO. 7.5" 7,9 '13 JUL 3 A14 io: 2 q A RESOLUTION AMENDING THE SUBDIVISION IMPROVEMENT AGREEMENT KLEBBA BAY ESTATES BY WAIVING THE REQUIREMENT FOR SIDEWALK CONSTRUCTION AS SET FORTH IN SAID AGREEMENT; ACCEPTING A COVENANT TO RUN WITH THE LAND POSTPONING THE IMMEDIATE CONSTRUCTION OF SIDEWALK AT SAID KLEBBA BAY ESTATES; WAIVING THE PROVISIONS OF ORDINANCE NO. 7990; ALL SUBJECT TO THE GRANTING OF A VARIANCE BY THE METROPOLITAN DADE COUNTY PLANNING DEPARTMENT. WHEREAS, by authority of Resolution No. 73-103, adopted February 8, 1973, the City Commission accepted the plat of KLEBBA BAY ESTATES and an Agreement between Frank L. Klebba, a single man and The City of Miami for the con- struction of all subdivision improvements required under the provisions of Chapter 54, Section 54-20, The Code of the City of Miami, Florida; and WHEREAS, Frank L. Klebba has requested the City to accept covenants under the provisions of Ordinance No. 7990 postponing sidewalk construction for each lot in said KLEBBA BAY ESTATES. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the Agreement dated December 7, 1972, between The City of Miami, Florida and Frank L. Klebba, a single man, for improvements at KLEBBA BAY ESTATES is hereby amended to waive all sidewalk construction as provided for under the provisions of Chapter 54, Section 54-20, Code of The City of Miami, Florida until such time as required by the Department of Public Works. Section 2. That the covenant to run with the land executed by Frank L. Klebba, a single man, postponing the immediate construction of sidewalk on ■ 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 :.9 20 21 22 23 24 25 26 27 28 29 ..§0 31 32 33 34 35 36 Lots 1 thru 19 inclusive, Iq,EBBA BAY ESTATES, as recorded in Plat Book 95, Page 20, of the Public Records of Dade County, Florida until such time as required by the Department of Public Works of the City of Miami, Florida, be, and the same is hereby accepted. Section 3. That the provisions of Ordinance No. 7990 requiring sidewalk to be constructed abutting property where there will be new construction be and they are hereby expressly waived until such time as required by the Department of Public Works. Section 4. The conditions as set forth in Sections 1, 2 and 3 above be and they are granted subject to the developer, Frank L. Klebba, receiving a variance from Section 28-15(3) (subdivision regulation) of the Code of Metropolitan Dade County. PASSED AND ADOPTED this /L day of Vimail" 1973. PREPARED AND APPROVED BY: R.
