RESOLUTION NO. 73-535
A RESOLUTION GRANTING A "CONDITIONAL
USE", AS PROVIDED IN ORDINANCE NO. 6871,
ARTICLE V, SECTION 1(6)(b), TO PERMIT
OFF-STREET PARKING LOT ON LOTS 8, 9 AND
10, BLOCK 4, FAIRMONT PARK 2ND AMD (11-63),
LOCATED AT 2296 S. W. 7TH STREET, IN
CONJUNCTION WITH SHEEHAN BUICK, LOT TO BE
USED FOR EMPLOYEES AND CUSTOMERS ONLY, WITH
NO ACCESS FROM S. W. 7TH STREET OR S. W.
23RD AVENUE; AND SUBJECT TO THE APPROVAL
OF THE WALL AND LANDSCAPING BY THE PLANNING
DEPARTMENT; ZONED R-1 (ONE -FAMILY) DISTRICT;
SUBJECT TO COMPLIANCE WITH LIGHTING REQUIRE-
MENTS AS SET OUT IN ORDINANCE NO. 8115 FOR
PARKING LOTS,SUBJECT TO THE APPLICANT PRO-
HIBITING PARKING OF EMPLOYEES AND CUSTOMERS CARS
IN THE ADJOINING ALLEY
WHEREAS, the City Planning and Zoning Board of
the City of Miami, at its meeting held on June 11, 1973,
passed and adopted by an 8 to 0 vote its Resolution No.
73-128, recommending granting a "conditional use" as provided
in Ordinance No. 6871, Article V, SECTION 1(6)(b), as hereinafter
set forth; and this Commission deems it advisable to the
public convenience and welfare and finds that the use will
not be detrimental or injurious to the character or the developmen
of the immediate neighborhood;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a"conditional
use". as provided in Ordinance No. 6871, Article V, Section
1(6)(b), to permit off-street parking lot on Lots 8, 9, and
10, Block 4, FAIRMONT PARK 2ND AMD (11-63), located at
2296 S. W. 7th Street, in conjunction with Sheehan Buick,
lot to be used for employees and customers only, with no
access from S. W. 7th street or S. W. 23rd Avenue; and subject
to the approval of the wall and landscaping by the Planning
Department; zoned R-1 (One -Family) District, be and the
same is hereby granted.

Section 2. The conditional use granted herein
is subject to compliance with the lighting requirements
for parking lots as set out in Ordinance No. 8115 of the
City of Miami, dated November 16, 1972, and also subject
to the applicant prohibiting parking of employees and cus-
tomers cars in the adjoining alley.
Section 3. This conditional use shall become null
and void unless the use is commenced within six months
of the effective date of this Resolution. Upon application,
the City Manager may, after review and determination that
substantial progress has been achieved by the applicant
in terms of project planning, extend the expiration date
of the conditional use for an additional period of time
not to exceed one (1) year. Said extension request shall
be filed with the City Manager two (2) weeks prior to the
expiration date of the initial six
period of the conditional use.
PASSED AND ADOPTED this 12th day of July,1973.

The Miami Planning Board, at its meeting of June 11, 1973, Item
43, following an advertised Hearing, adopted Resolution No. 73-128
by an 8 to 0 vote (one member absent), recommending "Conditional
Use" as listed in Ordinance No. 6871, ARTICLE V, Section 1 (6)(b),
to permit off-street parking lot on Lots 8, 9 and 10, Block 4,
FAIRMONT PARK 2ND AMD (11-63), located at 2296 S. W. 7th Street,
in conjunction with Sheehan Buick, lot to be used for employees
and customers only, with no access from S. W. 7th Street or S. W.
23rd Avenue; and subject to the approval of the wall and land-
scaping by the Planning Department; zoned R-1 (One -Family).
Seven objections were received in the mail.
A RESOLUTION to provide for this "Conditional Use" has been pre-
pared by the City Attorney's office and submitted for considera-
tion of the City Commission.
