TINUED WAIVER OF 15 OF 29 REQUIRED OFF-
STREET PARKING SPACES, FOR A PERIOD OF
ONE (1) YEAR FROM THIS DATE, AS PROVIDED
BY ORDINANCE NO. 6871, ARTICLE XXIII,
SECTION 2 (3) , ON LOTS 5 AND 6, BLOCK 2,
PHOENIX PARK (6-80), LOCATED AT 73-97
N. W. 76TH STREET, IN CONJUNCTION WITH
CONSTRUCTION OF A 23-UNIT APARTMENT FOR
THE ELDERLY, SITE ZONED R-3 (LOW DENSITY
MULTIPLE) DISTRICT.

WHEREAS, on November 19, 1970, the City Commission
passed and adopted Resolution No. 42005, granting a con-
tinued variance from Ordinance No. 6871, Article XXIII,
Section 2 (3) , as hereinafter set forth; and
WHEREAS, the Building Department reports that a
visual check of the property reveals no problems and
they have had no complaints regarding this property;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the continued waiver for 15
of 29 required off-street parking spaces, as provided in
Ordinance No. 6871, Article XXIII, Section 2(3), in conjunction
with construction of a 23-Unit apartment for the elderly
on Lots 5 and 6, Block 2, PHOENIX PARK (6-80), located
at 73-97 N. W. 76th Street, site zoned R-3 (Low Density
Multiple) District, be and the same is hereby granted for
a period of one (1) year from this date.
Section 2. The waiving of development of 15 of
29 required off-street parking spaces located at the real
property described in Section 1 above, is automatically

renewed for one-year periods until such time as the City
Commission of the City of Miami shall rescind its waiver
of 15 of 29 required off-street parking spaces granted herein.

The Miami City Commission, at its meeting of THURSDAY,
July 12, 1973, at 11:00 A. M., in CITY HALL, 3500 Pan
American Drive, Dinner Key, Miami, Florida, will consider
the following:

PHOENIX PARK (6-80)
At its meeting of November 19, 1970, the Miami City Commission
adopted Resolution No. 42005 granting permission as listed in
Ordinance No. 6871, ARTICLE XXIII, Section 2 (3), to waive
development for a period of one (1) year from the date of
issuance of Certificate of Occupancy, of 15 of the 29 required
off-street parking spaces, in conjunction with construction of
a 23-unit apartment for the elderly; property zoned R-3 (Low
Density Multiple).
The Certificate of Occupancy will have been issued one (1)
year on June 29, 1973, for this reason the City Commission will
review existing conditions relating to parking at the above
location and consider an extension of the variance as approved
on November 19, 1970.
IMPORTANT
The City Commission requests that PETITIONER be present or
represented at this meeting, and all interested real estate
owners are invited to express their views.

The Commission adopted Resolution No. 42005 on November 19, 1970,
which granted permission as listed in Ordinance No. 6871, ARTICLE
XXIII, Section 2 (3), to waive development for a period of one
(1) year from the date of issuance of Certificate of Occupancy,
of 15 of the 29 required off-street parking spaces, in conjunc-
tion with construction of a 23-unit apartment for the elderly;
zoned R-3 (Low Density Multiple).
Certificate of Occupancy was issued June 29, 1972.
Attached is a memorandum from R. E. Ferencik recommending the
continued waiver of development for additional parking for the
apartment building for the elderly.
It is suggested that this matter be placed on an early Agenda
for the consideration of the City Commission.

Several inspections of the subject property revealed no parking
problems as a result of the variance granted for off-street
parking.
Landscaping is being maintained according to the pertinent ordinaces.
Recommendation is hereby ;made to grant continued permission to
waive development of 15 of the 29 required off-street parking
spaces in conjunction with a 23-unit apartment for the elderly.
