BE IT ORDAIr'ED BY THE CO:~TiISSION OF THE CITY OF MIA~`iI, FLORIDA: Section 1. That Paragraph (b) of Section 34-59 entitled "Design Standards" is hereby deleted and a necv Paragraph (b) be substituted in lieu thereof to read as follows: "(b) Public and private parking lots located in co~r~nercial zones, except the C-3 zone, or public or private parking lots located in residential zones shall be provided with adequate light fixtures so that at no point on the lot shall there be less than one footcandle of. light." Section Z. That Section 34-63 entitled "Parking Lot Appeal Boars°'} prouyc:~inb cor ~nanibQrship on said board and curther providing for the method of appeal is hereby deleted and a new Section 34-63 be substituted in lieu thereof to read as follows: "Sec. 34-53. Parking Lot Review Board. (a) There is hereby established a board to be knocan as the Parking Lot Review Board consistinj of five (5) members appointing by the City ,tanager. (b) Any person or persons who believe they are, jointly or severally, aggrieved by any requirement as set forth in Sections 34-57 to 34-62, inclusive, thereto, may request in writing a hearing before the Board for a Waiver of Compliance faith the terms thereunder and a hearinj shall thereupon be scheduled within thirty (30) days, to be held on a date designated by the Chairman of the Board. (c) The Board, in considering the request for a Waiver of Compliance may ta'.~ce into account the location of the area, the use of the property and the exi.sten~e of other available lighting or other security measures commensurate with the intent and purpose of this Chapter. (d) The Board, at its first regular scheduled meeting, shall adopt rules of practice and procedure to be follocoed by persons applying for a tdaiver of Compliance and also shall establish rules of practice and procedure to be followed in the hearings held pursuant to the request for a Waiver of Compliance. (e) That the decision of the hearing held before the Parking Lot Review Board shall be the final administr~?tive relief available to the applicant and said decision shall be finial in all respects." . , ~ .,,.. ~. , , r ~-- i ~ r" -~- - -- ___--- Section 4. This ordinance is hereby declared to be an emergency measure on the ground of urgent public need for the preser- vation of peace, health, safety and property in the City of Miami. Section 5. The requirement of readinJ this ordinance on ~, t*,~o separate days is hereby dispensed caith by a vote of nat less than four-fifths of the members of the Commission.
