RESOLUTION NO. 73 "eVO
A RESOLUTION AUTHORIZING THE DIRECTOR OF
FINANCE TO PAY TO WALTER POSTULA, ATTORNEY
FOR PLAINTIFFS EARNESTINE BROWN, DAVID
SMART AND DONALD SMART, WITHOUT THE ADMISSION
OF LIABILITY, THE SUM OF $250.00 IN FULL AND
COMPLETE SETTLEMENT OF THEIR CLAIM AGAINST
THE CITY OF MIAMI FOR ALLEGED PERSONAL INJURIES
AND DAMAGES SUSTAINED BY P,,,TJAINTIFFS, UPON THE
EXECUTION OF A RELEASE RELEASING THE CITY OF
MIAMI FROM ALL CLAIMS AND DAMAGES.
WHEREAS, the plaintiffs, Earnestine Brown, David
Smart and Donald Smart, filed an action against the City of
Miami in the Circuit Court of Dade County, Florida, bearing
Number 73-6697, alleging that on or about February 5, 1971,
defendant City of Miami policemen mistakenly broke into the
plaintiffs' apartment, causing personal injuries and damages;
and
WHEREAS, this claim has been investigated by the Office
of the City Attorney and said Office recommends that this claim
be settled for the sum of $250.00;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the Director of Finance is hereby
directed to pay to Walter Postula, attorney for plaintiffs
Earnestine Brown, David Smart and Donald Smart, without the
admission of liability, the sum of $250.00 in full and complete
settlement of their claim against the City of Miami for alleged
personal injuries and damages sustained by them, upon the execu-
tion of a release releasing the City of Miami from all claims
and demands.
