A RESOLUTION ACCEPTING THE EASEMENT
EXECUTED BY THE WILLARK HOUSE - S.A.
TO LAY AND MAINTAIN A SANITARY SEWER
IN THE EAST TEN (10) FEET OF LOT 50,
BLOCK 1, BISCAYNE ISLAND RESUBDIVISION
(40-34); AND DIRECTING THE PROPER OFFICIAL
OF THE CITY OF MIAMI TO RECORD SAID GRANT
OF EASEMENT IN THE PUBLIC RECORDS OF
DADE COUNTY.
WHEREAS, in order to provide sanitary sewers for
the Venetian Causeway toll plaza as a part of San Marco
Improvement, an easement is needed for a sanitary sewer
in the east ten (10) feet of Lot 50, Block '1, of BISCAYNE
ISLAND RESUBDIVISION; and
WHEREAS, the Willark House - SA (owner of this
property), through Alfredo Grisar and Nestor Morales,
president and secretary, respectively, executed and delivered
to the City a Grant of Easement of the ten feet for the
purposes of laying and maintaining this sanitary sewer; and
WHEREAS, it is now in order for the City Commission
to accept the easement and to have it recorded in the Public
Records of Dade County;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the December 27, 1971, Grant of
Easement for the east ten (10) feet of Lot 50, Block 1, of
BISCAYNE ISLAND RESUBDIVISION submitted by the Willark House -
SA, through Alfredo Grisar and Nestor Morales, be and the
same is hereby accepted.

GRANT OF EASEMENT
TO LAY AND MAINTAIN A SANITARY SEWER
THIS INDENTURE, made this 27th day of December , A.D. ,
1971, between THE WILLARK HOUSE - SA, c/o Nestor Morales, Attorney,
2279 S.W. 22nd Street, Miami, Florida, existing under the laws of
the Republic of Panama and authorized to transact business in the
State of Florida, party of the first part, and THE CITY OF MIAMI,
a municipal corporation of the State of Florida, party of the
second part;
WITNESSETH, that said party of the first part, for and in
consideration of the sum of One Dollar ($1.00) and other good and
valuable considerations, to it in hand paid by said party of the
second part, the receipt whereof is hereby acknowledged, does here-
by grant, give and convey to the party of the second part, its
successors and assigns, forever, a permanent easement for the pur-
pose of constructing, laying and maintaining a Sanitary Sewer
through, over, across and under the surface of the following des-
cribed land, situated in The City of Miami, County of Dade and
State of Florida, to wit:
The east ten (10) feet of Lot 50, Block 1,
of BISCAYNE ISLAND RESUBDIVISION, accord-
ing to the plat thereof, as recorded in
Plat Book 40, at Page 34, of the Public
Records of Dade County, Florida.
IT IS UNDERSTOOD AND AGREED by and between the parties here-
to that THE CITY OF MIAMI, a municipal corporation, agrees that the
said Sanitary Sewer to be constructed under the property hereby
given for such right, shall always be maintained so as not to be
or become a nuisance.

SHOULD the above easement be abandoned or discontinued by
operation of law or otherwise, the said easement shall cease and
revert to the Grantor herein, its successors or assigns.
IN WITNESS WHEREOF, the said party of the first part has
caused these presents to be signed in its name by it' proper offi-
certs, and its corporate seal to be affixed, attested by its Secre-
tary, the day and year above written.

their free act and deed as such officers for the uses and purposes
therein mentioned and that they affixed thereto the official seal
of said corporation, and that the said instrument is the act and deed
of said corporation.
