RESOLUTION NO. 3'' o
A RESOLUTION GRANTING A VARIANCE FROM
ORDINANCE NO. 6871, ARTICLE XVII,
SECTION 4(1), TO PERMIT CONSTRUCTION
OF PARKING GARAGE ON LOT 15, BLOCK 12,
BUENA VISTA GARDENS (5- 4 5) , LOCATED
AT 355 N. W. 54TH STREET, WITH 0'
REAR SETBACK (10' REQUIRED), SITE
ZONED C-5 (LIBERAL COMMERCIAL) DISTRICT.
WHEREAS, the City Planning and Zoning Board of
the City of Miami, at its meeting on May 7, 1973, passed
and adopted by a 8 to 0 vote its Resolution No. 73-109,
recommending granting a variance from Ordinance No. 6871,
Article XVII, Section 4(1), as hereinafter set forth; and
this Commission deems it advisable in the interest of the
general welfare of the City of Miami to grant this variance
requested on the ground that due to peculiar circumstances
affecting this parcel of land practical difficulties and
unnecessary hardships would impair the owner's rights to
some reasonable use of the property under a C-5 (Liberal
Commercial) District;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a variance
from Ordinance No. 6871, Article XVII, Section 4(1), to
permit construction of parking garage on Lot 15, Block 12,
BUENA VISTA GARDENS (5-45), located at 355 N. W. 54th
Street, with 0' rear setback (10' required), site zoned
C-5 (Liberal Commercial) District, be and the same is hereby
granted.
Section 2. This variance shall become null and
void unless the use is commenced within six months of the

effective date of this Resolution. Extension may be granted
by the City Manager pursuant to the provisions of Article
XXXI, Section 4, of Ordinance No. 6871.

The Miami Planning Board, at its meeting of May 7, 1973, Item #4,
following an advertised Hearing, adopted Resolution No. 73-109
by an 8 to 0 vote (one member absent), recommending Variance from
Ordinance No. 6871, ARTICLE XVII, Section 4 (1), to permit construc-
tion of parking garage on Lot 15, Block 12, BUENA VISTA GARDENS
(5-45), located at 355 N. W. 54th Street, with 0' rear setback (10'
required); zoned C-5 (Liberal Commercial).
No objections were received in the mail.
A RESOLUTION to provide for this Variance has been prepared by the
City Attorney's office and submitted for consideration of the City
Commission.
