A RESOLUTION GRANTING A VARIANCE FROM
ORDINANCE NO. 6871, ARTICLE IV, SECTION
25(1), TO PERMIT CONSTRUCTION OF GASOLINE
STATION ON LOTS 1, 2 AND 3, BLOCK 2,
FEDERAL WAY AMD (25-6), LOCATED AT AP-
PROXIMATELY 480 N. E. 79TH STREET, BEING
13,740 SQUARE FEET IN AREA (15,000 SQ. FT.
REQUIRED), WITH THREE STREET FRONTAGES,
EACH OF WHICH DOES NOT EXCEED THE 150'
REQUIRED, SUBJECT TO A REVISED SITE PLAN
FOR REVIEW BY THE PLANNING DEPARTMENT AND
NO ACCESSORY USES SUCH AS TRUCK OR TRAILER
RENTALS, CAR WASHES, ETC., ON THE PROPERTY;
SITE ZONED C-4 (GENERAL COMMERCIAL) DISTRICT.
WHEREAS, the City Planning and Zoning Board of
the City of Miami, at its meeting on April 23, 1973, passed
and adopted by a 9 to 0 vote its Resolution No. 73-96,
recommending granting a variance from Ordinance No. 6871,
Article IV, Section 25(1), as hereinafter set forth; and
this Commission deems it advisable in the interest of the
general welfare of the City of Miami to grant this variance
requested on the ground that due to peculiar circumstances
affecting this parcel of land practical difficulties and
unnecessary hardships would impair the owner's rights to
some reasonable use of the property under a C-4 (General
Commercial) District;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a variance
from Ordinance No. 6871, Article IV, Section 25(1), to permit
construction of Gasoline Station on Lots 1, 2, and 3, Block 2,
FEDERAL WAY AMD (25-6), located at approximately 480 N.E.
79th Street, being 13,740 square feet in area (15,000 sq.
ft. required), with three street frontages, each of which
does not exceed the 150' required, subject to revised site
plan for review by the Planning Department and no accessory
uses such as truck or trailer rentals, car washes, etc.,
on the property, site zoned C-4 (General Commercial) District,
be and the same is hereby granted.

Section 2. This variance shall become null and void
unless the use is commenced within six months of the effective
date of this Resolution. Extension may be granted by the
City Manager pursuant to the provisions of Article XXXI,
Section 4, of Ordinance No. 6871.

The Miami Planning Board, at its meeting of tipril 23, 1973, Item
#4, following an advertised Hearing, adopted Resolution No. 73-96
by a 9 to 0 vote recommending Variance from Ordinance No. 6871,
ARTICLE IV, Section 25 (1), to permit construction of Gasoline
Station on Lots 1, 2 and 3, Block 2, FEDERAL WAY AMD (25-6),
located at approximately 480 N. E. 79th Street, being 13,740
square feet in area (15,000 sq. ft. required), with three street
frontages, each of which does not exceed the 150' required,
subject to a revised site plan for review by the Planning Depart-
ment and no accessory uses such as truck or trailer rentals, car
washes, etc., on the property; zoned C-4 (General Commercial).
One objection was received in the mail.
A RESOLUTION to provide for this Variance has been prepared by the

Commission.
