A RESOLUTION GRANTING A "CONDITIONAL USE", AS PROVIDED IN ORDINANCE NO. 6871, ARTICLE VI, SECTION 1 (4-A), TO PERMIT CONSTRUCTION OF PLANNED UNIT DEVELOPMENT ON LOTS 1 AND 2 LESS SE'LY 8.25', LOTS 3, 25 AND N 50' LOT 24, BLOCK 12, NEW BISCAYNE AMD (B-16), LOCATED AT APPROXIMATELY 2650 BIRD AVENUE, CONSISTING OF 8 UUITS IN 5 BUILDINGS, AS PER PLAN ON FILE IN PLANNING BOARD OFFICE, SITE ZONED R-2 (TWO-FAMILY) DISTRICT. q2 WHEREAS, the City Planning and Zoning Board of the City of Miami, at its meeting held on April 23, 1973, passed and adopted by a 9 to 0 vote its Resolution No. 73-94, recommending granting a "conditional use" as provided in Ordinance No. 6871, Article VI, Section 1 (4-A), as hereinafter set forth; and this Commission deems it advisable to the public convenience and welfare and finds that the use will not be detrimental or injurious to the character or the development of the immediate neighborhood; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the application for a"conditional use" as provided in Ordinance No. 6871, Article VI, Section 1 (4-A), to permit construction of Planned Unit Development on Lots 1 and 2 less SE'ly 8.25', Lots 3, 25 and N 50' Lot 24, Block 12, NEW BISCAYNE AflD (B-16)., located at approximately 2650 Bird Avenue, consisting of 8 units in 5 buildings,, as per plan on file in Planning Board Office, site zoned R-2 (Two -Family) District, be and the same is hereby granted. Section 2. This conditional use shall become null and void unless the use is commenced within six months of the effective date of this Resolution. Upon application, the City Manager may, after review and determination that substantial progress has been achieved by the applicant 6 7 th 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 .40 31 32 33 34 35 36 in terms of project planning, extend the expiration date of the conditional use for an additional period of time not to exceed one (1) year. Said extension request shall +•e filed with the City Manager two (2) weeks prior to the expiration date of the initial six (6) months effective period of the conditional use. Reese City of Miami, Florida Re: "CONDITIONAL USE" - RECOMMENDED Approximately 2650 Bird Avenue Lots 1 and 2 less SE'ly 8.25', Lots 3, 25 and N 50' Lot 24, Block 12, NEW BISCAYNE AMD (B-16) Applicant: Borroto & Lee Gentlemen: The Miami Planning Board, at its meeting of April 23, 1973, Item #2, following an advertised Hearing, adopted Resolution No. 73-94 by a 9 to 0 vote recommending "Conditional Use" as listed in: Ordinance No. 6871, ARTICLE VI, Section 1 (4-A), to permit con- struction of Planned Unit Development on Lots 1 and 2 less SE'ly 8.25', Lots 3, 25 and N 50' Lot 24, Block 12, NEW BISCAYNE AMD (B-16), located at approximately 2650 Bird Avenue, consisting of 8 units in 5 buildings, as per plan on file in Planning Board Office; zoned R-2 (Two -Family). Eleven objections were received in the mail. A RESOLUTION to provide for this "Conditional Use" has been pre- pared by the City Attorney's office and submitted for considera- tion of the City Commission.
