AN ORDINANCE AMENDING ORDINANCE NO.
6871, THE COMPREHENSIVE ZONING ORDINANCE
FOR THE CITY OF MIAMI, BY CHANGING THE
ZONING CLASSIFICATION FOR LOT 3, BLOCK 7,
BUENA VISTA PARK AMD (2-89), LOCATED AT
3521 N. W. llth COURT, FROM C-4 (GENERAL
COMMERCIAL) DISTRICT TO R-2 (TWO-FAMILY)
DISTRICT; AND BY MAKING THE NECESSARY
CHANGES IN THE ZONING DISTRICT MAP MADE
A PART OF SAID ORDINANCE NO. 6871 BY
REFERENCE AND DESCRIPTION IN ARTICLE III,
SECTION 2, THEREOF; ASD BY REPEALING ALL
LAWS IN CONFLICT HEREWITH.
WHEREAS, the Planning and Zoning Board of the
City of Miami, at its meeting held on March 12, 1973,
passed and adopted by a 9 to 0 vote, its Resolution No.
73-44, recommending granting a change in zoning classifi.c~ .r;n,
as hereinafter set forth; and
WHEREAS, it is deemed advisable in the best
interest of the general welfare of the City of Miami and
its inhabitants to grant a change in zoning classification,
as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That Ordinance No. 6871, the Compretiive
Zoning Ordinance for the City of Miami, be and the same is
hereby amended by changing the zoning classification for
of 3, Block 7, BUENA VISTA PARK AMD (2-89) , located at
3521 N. W. llth Court, from C-4 (General Commercial) Distrir`-
to R-2 (Two -Family) District; and by making the necessary
changes in the zoning district map made a part of said
•rdinance No. 6871 by reference and description in
ticle III, Section 2, thereof.

Section 2. That all laws, or parts of laws, in
conflict herewith, be and the same are hereby repealed
insofar as the above described land is involved.
Section 3. It is declared to be the legislative
intent of this body that if any section, subsection, sentence,
phrase or provision of this Ordinance is held invalid, the
remainder of the Ordinance shall not be affected.

PLANNING DEPARTMENT RECOMMENDATION: "APPROVAL"
The proposed zone change to R-2 wculd be an upgrading
of the existing C-4 classification. Land use in the
vicinity of the subject property is mixed one and
two-family residential. Adjacent property to the
north has been fully developed with a commercial
structure. The shift of the zoning district boundary
line in the manner requested will have no detrimental
effect on the surrounding area.
Mr. Martinez: All of those to speak on Item #3 should please
come forward and be sworn in. Will the applicants take the mike on
my right. State your name and address for the Record, ma'am, and
state your case.
Mrs. Maldonado: My name is Gloria Maldonado, I live at
3456 N. W. llth Court, and I'm over here in behalf of my mother-in-
law.
Mr. Martinez: Yes, Mrs. Maldonado, what else, would you give
us a little explanation.
Mrs. Maldonado: Yes. Around six month ago, she finished pay-
ing off her house, home, the home is frame and it is beyond repair.
Now, we would like to demolish this home, and if possible, put up
another structure here, and she could have some sort of an income.
At the present time, she's got Miller Glass on one side, and she
has a triplex on the other.
Mr. Martinez: Your request is for moving to an R-2 from the
C-4.
Nrs. Maldonado: No, it is the C-4 and they want it R-2.
Right now, there is a frame house which is beyond repair, I mean,
you really can't do anything with it.
Mr. Martinez: Yes, 1 saw it, ma'am.
Mrs. Maldonado: Right, and we'd like to, you know, demolish
that home and put up another structure.

Mr. Martinez: All right, well, let me see if there is anyone
here in objection. Is there anyone here in objection to this item?
Anyone is objection to Item #3? None. We will close the public hear-
ing, and have discussion among the Board Members, because I see that
you have approval from the Planning Department. All right. The
public hearing is closed, and we will have discussion among the
Board Members. If none, Mrs. Fernandez, this is in your district.
Mrs. Fernandez: I want to ask the applicant if she knows about
the recommendation of the Staff? Did you read the recommendation of
the Staff?
Mrs. Maldonado: No, I haven't.
Mr. Martinez: Mr. Gort, will you hand her a copy, and we will
give her a minute to read it.
Mrs. Fernandes: Well, Iwent by that neighborhood, and I agree
with the recommendation of the Staff for approval, that this shift of
zoning will not be detrimental of the surrounding area and of the
Country. It will be beneficial to that area.
Mr. Martinez: I have a motion for approval on Item #3.
