A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI, DETERMINING AND FINDING THE NECESSITY FOR A PUBLIC PURPOSE IN ORDER TO PROVIDE FOR ADDITIONAL PARK FACILITIES FOR THE CREATION OF THE LATIN COMMUNITY RIVERFRONT PARK, TO ACQUIRE BY CONDEMNATION OR -OTHERWISE THE FEE SIMPLE TITLE TO CERTAIN LANDS DESIGNATED HEREIN AND DIRECTING THE DEPARTMENT OF LAW OF THE CITY OF MIAMI TO INSTITUTE AND PROSECUTE TO A CONCLUSION ALL OF THE NECESSARY LEGAL ACTIONS TO ACQUIRE THE FEE SIMPLE TITLE TO THIS PROPERTY AS SOON AS IT IS LEGALLY POSSIBLE, INCLUDING THE FILING OF THE DECLARATYON OF TAKING AND THE POSTING OF THE NECESSARY BOND. WHEREAS, the City of Miami is empowered to acquire in fee simple by condemnation or otherwise, property real or personal, or any estate or interest therein for any of the purposes of the city; and WHEREAS, the acquisition of the following described property has been found, after due consideration, to be necessary and for a public purpose to provide for park and recreational facilities; and WHEREAS, it is necessary that appropriate steps to acquire the described property be taken so that said property may be made ready to accommodate the public need for additional park facilities for the creation of the Latin Community Riverfront Park; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. It is hereby determined and found necessary for a public purpose in order to provide for additional park facilities for the creation of the Latin Community Riverfront Park that the following property be acquired in fee simple -1- by gift, purchase, or condemnation, to wit: Lots 1B through 6B inclusive and Lots 1M through 6M inclusive, Lots 1H, 2H, 1MC, 2MC, 1L through 3L inclusive and Lots 7B through 9B inclusive of Riverside Waterfronts (25-72) and Lots 2 through 6 inclusive of Block 21 South of A. L. Knowlton Map of Miami (B-41) . Section 2. That the City of Miami, Florida, its agents and employees are hereby directed to acquire by gift, purchase, or condemnation, the property described in Section 1 above, the fee simple title to the &hove described property as soon as it is legally possible, including the filing of a declaration of taking and utilization of any and all statutes of the State of Florida applicable thereto. Section 3. Said City of Miami, its employees and agents are authorized and directed to incur all the necessary expenses by way of surveys, abstracts of title, and in the acquiring of the other information necessary to institute and maintain said condemnation proceedings.
