A RESOLUTION GRANTING A VARIANCE FROM
ORDINANCE NO. 6871, ARTICLE XI, SECTION 2,
TO PERMIT CONSTRUCTION OF OFFICE BUILDING
ON LOT 5, BLOCK 93S, MIAMI HEIGHTS, LO-
CATED AT 228 SW 13TH STREET, BEING 50 FEET
IN WIDTH INSTEAD OF REQUIRED 60 FEET, ZONED
R-C
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
That a variance permit be, and it is, hereby granted
from Ordinance No. 6871, Article XI, Section 2, to permit con-
struction of office building on Lot 5, Block 93S, Miami Heights,
located at 228 SW 13th Street, being 50 feet in width instead of
required 60 feet, zoned R-C.
PASSED AND.ADQPTED this 26th day of April, 1973.

A RESOLUTION GRANTING A. VARIANCE FROM
ORDINANCE NO. 6871, AR'DICLE XI, SECTIONS
2, 3 (2) (a) , AND 6, PERMIT CONSTRUCTION
OF OFFICE BUILDING/ON LOT 5, BLOCK 93S,
MIAMI HEIGHTS (5429), LOCATED AT 228
S. W. 13TH STREET, BEING 50' IN WIDTH
(60' REQUIRED), WITH 5' SIDE SETBACKS
(9' REQUIREO), WITH 31% LOT COVERAGE
(30% PERMITTED), SUBJECT TO INTENSIVE
LANDSCAPING AS APPROVED BY THE PLANNING
DEPARTMENT, SITE ZONED R-C (P.ESIDENCE-
OFFICE) DISTRICT.
WHEREAS, the City Planning and Zoning Board of
the City of Miami, at its meeting on February 26, 1973,
passed and adopted by a 4 to 4 vote, its Resolution No.
73-29,which constitutes a denial of a variance from Ordinance No.
6871, Article XI, Sections 2, 3(2)(a) and 6, as hereinafter
set forth; and this Commission deems it advisable in the interest
of the general welfare of the City of Miami to grant this
variance requested on the ground that due to peculiar circumstances
affecting this parcel of land practical difficulties and
unnecessary hardships would impair the owner's rights
to some reasonable use of the property under a R-C (Residence -
Office) District;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a variance
from Ordinance No. 6871, Article XI, Sections 2, 3(2)(a)
and 6, to permit construction of office building on Lot 5,
Block 93S, MIAMI HEIGHTS (5-29), located at 228 S. W. 13th
Street, being 50' in width (60' required), with 5' side
31 setbacks (9' required), with 31% Lot coverage (30%
32 permitted), subject to intensive landscaping as approved
33 by the Planning Department, site zoned R-C (Residence -
Office) District, be and the same is hereby granted.

Section 2. This variance shall become null and
void unless the use is commenced within six months of the
effective date of this Resolution. Extension may be granted
by the City Manager pursuant to the provisions of Article
XXXI, Section 4, of Ordinance No. 6871.

The Miami Planning Board, at its meeting of February 26, 1973, Item
#1, following an advertised Hearing, adopted Resolution No. 73-29
by a 4 to 4 vote (One member absent) which constitutes a (DENIAL)
for Variance from Ordinance No. 6871, ARTICLE XI, Sections 2, 3 (2)
(a) and 6, to permit construction of office building on Lot 5, Block
93S, MIAMI HEIGHTS (5-29), located at 228 S. W. 13th Street, being
50' in width (60' required); with 5' side setbacks (9' required),
with 31% Lot Coverage (30% permitted), subject to intensive land-
scaping as approved by the Planning Department; zoned R-C
(Residence -Office).
Six objections were received in the mail.
A RESOLUTION to provide for this Variance has been prepared by the
City Attorney's office and submitted for consideration of the City
Commission.
