HomeMy WebLinkAboutR-73-02801 3 4 5 6 7 ct� Our 8 9 10 11 12 13 14 15 16 17 18 20 21 22 23 24 25 26 27 28 29 )30 31 32 33 34 35 RESOLUTION NO. ,ir„6`1.2wrCJ A RESOLUTION GRANTING A "CONDITIONAL y: USE", AS PROVIDED IN ORDINANCE NO. 6871, ARTICLE VI, SECTION 1 (4-A), TO PERMIT CONSTRUCTION OF PLANNED UNIT DEVELOPMENT CONSISTING OF 21 UNITS IN 11 STRUCTURES ON LOTS 11 THRU 15 AND 31 THRU 35, BLOCK 4, JACKSON PEACOCK'S SUB (3-18), LOCATED AT APPROXIMATELY 3180 BIRD AVENUE, SUBJECT TO DEDICATION OF PROPERTY WITHIN THE ZONED STREET WIDTH ON BIRD AVENUE, S.W. 32ND AVENUE AND JACKSON AVENUE, SUBJECT TO SUBMISSION OF A TREE SURVEY AND LANDSCAPE PLAN FOR APPROVAL BY THE PLANNING DEPARTMENT, WITH RELOCATION OF TRASH COURT TO 32ND AVENUE AND READJUSTMENT OF PARKING LOCATIONS TO BE APPROVED BY THE PLANNING DEPARTMENT, SITE ZONED R-2 (TWO-FAMILY) DISTRICT. WHEREAS, the City Planning and Zoning Board of the City of Miami, at its meeting held on March 26, 1973, passed and adopted by a 9 to 0 vote its Resolution No. 73-67, recommending granting a "conditional use" as provided in Ordinance No. 6871, Article VI, Section 1 (4-A), as hereinafter set forth; and this Commission deems it advisable to the public convenience and welfare and finds that the use will not be detrimental or injurious to the character or the development of the immediate neighborhood; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the application for a"conditional use" as provided in Ordinance No. 6871, Article VI, Section 1 (4-A), to permit construction of Planned Unit Development consisting of 21 units in 11 structures on Lots 11 thru 15 and 31 thru 35, Block 4, JACKSON PEACOCK'S SUB (3-18), located at approximately 3180 Bird Avenue, subject to dedication of property within the zoned street width on Bird Avenue, S. W. 32nd Avenue and Jackson Avenue, subject to submission of a tree survey and landscape plan for approval by the Planning Department, with relocation of Trash Court to 32nd Avenue and readjustment of parking locations to be approved by the Planning Department, site zoned R-2 (Two -Family) District, be and the same is hereby granted. 36 1 2 Section 2. This conditional use'shall become null and void unless the use is commenced within six months of the effective date of this Resolution. Upon application, the City Manager may, after review and determination that substantial progress has been achieved by the applicant in terms of project planning, extend the expiration date of the conditional use for an additional period of time not to exceed one (1) year. Said extension request shall be filed with the City Manager two (2) weeks prior to the expiration date of the initial six (6) months effective period of the conditional use. Gentlemen: The Miami Planning Board, at its meeting of March 26, 1973., Item *5, following an advertised Hearing, adopted Resolution No. 73-67 by a 9 to 0 vote recommending "Conditional Use" as listed in Ordinance No. 6871, ARTICLE VI, Section 1 (4-A), to permit construc- tion of Planned Unit Development consisting of 21 units in 11 struc- tures on Lots 11 thru 15 and 31 thru 35, Block 4, JACKSON PEACOCK'S SUB (3-18), located at approximately 3180 Bird Avenue, subject to dedication of property within the zoned street width on Bird Avenue, S. Two objections were received in the mail. A RESOLUTION to provide for this "Conditional Use" has been prepared by the City Attorney's office and submitted for consideration of the City Commission.
