RESOLUTION NO. 73 - 2 77
A RESOLUTION GRANTING A VARIANCE FROM
ORDINANCE NO. 6871, ARTICLE V, SECTIONS
3(2)(b) and 3 (3) (a) ; AND ARTICLE XXIII,
SECTION 4(18), TO PERMIT CONSTRUCTION
OF ADDITION TO CHURCH ON LOTS 5, 6, 7
AND 8, BLOCK 5, NEW LIBERTY CITY (39-
28), LOCATED AT 1571 N.W. 68TH TERRACE,
WITH 13.5' REAR SETBACK (20' REQUIRED),
WITH 16' SIDE SETBACK (20' REQUIRED),
WAIVING 18 OF 26 REQUIRED OFF-STREET
PARKING SPACES, UNDER CONCURRENT PETITION
FOR "CONDITIONAL USE", SUBJECT TO
DEDICATION OF THE SOUTH 5' OF LOT 7,
ZONED R-1 (ONE -FAMILY) DISTRICT.

WHEREAS, the City Planning and Zoning Board
of the City of Miami, at its meeting on March 12, 1973,
passed and adopted by a 9 to 0 vote its Resolution No.
73-52, recommending granting a variance from Ordinance
No. 6871, Article V, Sections 3(2)(b) and 3(3)(a), and
Article XXIII, Section 4(18), as hereinafter set forth;
and this Commission deems it advisable in the interest of
the general welfare of the City of Miami to grant this variance
requested on the ground that due to peculiar circumstances
affecting this parcel of land practical difficulties and
unnecessary hardships would impair the owner's rights
to some reasonable use of the property under a R-1 District;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a variance
from Ordinance No. 6871, Article V, Sections 3(2)(b) and
3(3)(a), and Article XXIII, Section 4(18), to permit
construction of addition to church on Lots 5, 6, 7, and
8, Block 5, NEW LIBERTY CITY (39-28), located at 1571
N.W. 68th Terrace, with 13.5' rear setback (20' required),
with 16' side setback (20' required), waiving 18 of 26

required off-street parking spaces, under concurrent
petition for "Conditional Use", subject to dedication of
the south 5' of Lot 7, zoned R-1 (One -Family) District,
be and the same is hereby granted.
Section 2. This variance shall become null
and void unless the use is commenced within six months
of the effective date of this Resolution. Extension may
be granted by the City Manager pursuant to the provisions
of Article XXXI, Section 4, of Ordinance No. 6871.

The Miami Planning Board, at its meeting of March 12, 1973, Item
#8 (b), following an advertised Hearing, adopted Resolution No.
73-52 by a 9 to 0 vote recommending Variance from Ordinance No.
6871, ARTICLE V, Sections 3 (2) (b) and 3 (3) (a); and ARTICLE
XXIII, Section 4 (18), to permit construction of addition to
Church on Lots 5, 6, 7 and 8, Block 5, NEW LIBERTY CITY (39-28),
located at 1571 N. W. 68th Terrace, with 13.5' rear setback (20'
required), with 16' side setback (20' required), waiving 18 of 26
required off-street parking spaces, under concurrent petition for
"Conditional Use", subject to dedication of the south 5' of Lot 7,
zoned R-1 (One -Family).
No objections were received in the mail.
A RESOLUTION to provide for this Variance has been prepared by the
City Attorney's office and submitted for consideration of the City
Commission.
