A RESOLUTION GRANTING A "CONDITIONAL
USE", AS PROVIDED IN ORDINANCE NO. 6871,
ARTICLE XI, SECTION 1(5)(b), TO PERMIT
"DRIVE-IN TELLER" ON TENTATIVE PLAT #857 -
"LITTLE RIVER CENTER", LOCATED AT AP-
PROXIMATELY 175 N. E. 79TH STREET, SUBJECT
TO SUBMISSION OF A LANDSCAPE PLAN FOR
REVIEW BY THE PLANNING DEPARTMENT; ZONED
C-1 (LOCAL COMMERCIAL) DISTRICT AND
C-2 (COMMUNITY COMMERCIAL) DISTRICT.
WHEREAS, the City Planning and Zoning Board of
the City of Miami, at its meeting held on March 12, 1973,
passed and adopted by a 9 to 0 vote its Resolution No.
73-46, recommending granting a "conditional use" as provided
in Ordinance No. 6871, Article XI, Section 1 (5) (b) ,
as hereinafter set forth; and this Commission deems
it advisable to the public convenience and welfare and
finds that the use will not be detrimental or injurious
to the character or the development of the immediate
neighborhood;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a"conditional
use" as provided in Ordinance No. 6871, Article XI,
Section 1(5)(b), to permit "Drive -In Teller" on Tentative
Plat #857 - "LITTLE RIVER CENTER", located at approximately
175 N. E. 79th Street, subject to submission of a landscape
plan for review by the Planning Department; zoned C-1
(Local Commercial) District and C-2 (Community Commercial)
District, be and the same is hereby granted.
Section 2. This conditional use shall become
null and void unless the use is commenced within six
months of the effective date of this Resolution. Upon

application, the City Manager may, after review and determination
that substantial progress has been achieved by the applicant
in terms of project planning, extend the expiration date
of the conditional use for an additional period of time
not to exceed one (1) year. Said extension request shall
be filed with the City Manager two (2) weeks prior to
the expiration date of the initial six (6) months effective
period of the conditional use.

Gentlemen:
The Miami Planning Board, at its meeting of March 12, 1973, Item
#4 (b), following an advertised Hearing, adopted Resolution No.
73-46 by a 9 to 0 vote recommending "Conditional Use" as listed
in Ordinance No. 6871, ARTICLE XI, Section 1 (5) (b), to permit
"Drive-in Teller" on Tentative Plat #857 - "LITTLE RIVER CENTER",
located at approximately 175 N. E. 79th Street, subject to sub-
mission of a landscape plan for review by the Planning Department;
zoned C-1 (Local Commercial) and C-2 (Community Commercial).
No obJections were received in the mail.
A RESOLUTION to provide for this "Conditional Use" has been pre-
pared by the City Attorney's office and submitted for considera-
tion of the City Commission.
