A RESOLUTION ACCEPTING THE PLAT ENTITLED
"LEAR SUBDIVISION", A SUBDIVISION IN THE
CITY OF MIAMI, FLORIDA; ACCEPTING THE
DEDICATIONS SHOWN ON SAID PLAT; ACCEPTING
A COVENANT TO RUN WITH THE LAND POSTPONING
THE IMMEDIATE CONSTRUCTION OF ASPHALTIC
CONCRETE PAVEMENT AND GRADING AND SHAPING
OF SIDE PARKWAY AS NECESSARY; AND AUTHORIZ-
ING AND DIRECTING THE CITY MANAGER AND CITY
CLERK TO EXECUTE THE PLAT.

WHEREAS, the City Planning and Zoning Board and the
Department of Public Works have recommended the acceptance
of the Plat; and
WHEREAS, it is recommended that the developers of LEAR
SUBDIVISION execute a Covenant to Run With the Land postponing
the immediate construction of asphaltic concrete pavement and
grading and shaping of side parkway as necessary;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, F LOR IDA :
Section 1. The Plat entitled LEAR SUBDIVISION, being a
subdivision in the N.E. 1/4, Section 26, Township 53 South,
Range 41 East, City of Miami, Dade County, Florida, which by
reference is made a part hereof as if fully incorporated
herein and the dedications as shown thereon together with all
existing and future plantings, trees and shrubbery on said
property, to the perpetual use of the public, be and the same
are hereby accepted and confirmed by the City of Miami, Florida.
Section 2. The Covenant to Run With the Land executed by
Stanley Lear and Blanche Lear, his wife, postponing the immediate

construction of asphaltic concrete pavement 20 feet wide
from a point 45 feet North of the ML of N.W. 34th Street
'�► to North line of Lot•• 1, LEAR SUBDIVISION, including 8-inch
lime rock base course and 1-inch asphaltic concrete surface
and grading and shaping of side parkway as necessary, until
such time as required by the Department of Public Works of
the City of Miami, Florida, be and the same be accepted and
recorded after the Plat has been recorded in the Public Records
of Dade County, Florida.
Section 3. Of all other requirements of State law con-
cerning the posting of a Performance Bond for the construction
of improvements, that portion pertaining to the maintenance of
said improvements is hereby expressly waived.
Section 4. The requirements of State law concerning the

showing of grades of rights -of -way on the Plat are hereby
expressly waived.
Section 5. The City Manager and the City Clerk, of the
City of Miami, Florida, are hereby authorized and directed to
execute the Plat.
