City of Miami Legislation Allapattah CRA Resolution ACRA-R-26-0002 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 19408 Final Action Date: 6/11/2026 A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE ALLAPATTAH REDEVELOPMENT DISTRICT COMMUNITY REDEVELOPMENT AGENCY ("ALLAPATTAH CRA"), WITH ATTACHMENT(S), DIRECTING THE INTERIM EXECUTIVE DIRECTOR TO TRANSMIT THE COMMUNITY REDEVELOPMENT PLAN, ATTACHED AND INCORPORATED AS EXHIBIT "A", REGARDING CERTAIN GEOGRAPHIC AREA OF THE CITY OF MIAMI, FLORIDA ("CITY") KNOWN AS ALLAPATTAH, GENERALLY BOUNDED ON THE NORTH BY STATE ROAD 112/AIRPORT EXPRESSWAY, ON THE EAST BY INTERSTATE-95 AND NORTHWEST 7TH AVENUE, ON THE SOUTH BY THE MIAMI RIVER, AND ON THE WEST BY NORTHWEST 19TH AVENUE, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "B" ATTACHED AND INCORPORATED ("AREA") TO THE LOCAL PLANNING AGENCY OF THE CITY OF MIAMI ("CITY") FOR REVIEW AND RECOMMENDATIONS AT ITS NEXT AVAILABLE MEETING, IN ACCORDANCE WITH SECTION 163.360, FLORIDA STATUTES; PROVIDING FOR THE INCORPORATION OF RECITALS AND AN EFFECTIVE DATE. WHEREAS, the Florida Legislature enacted the Community Redevelopment Act of 1969, which is presently codified in Chapter 163, Part III, Sections 163.330 through 163.464, Florida Statutes ("Act"); and WHEREAS, on October 15, 2024, the City of Miami ("City") Commission, adopted Resolution No. R-24-0415, which directed the City Manager to, among other things, hire consultants to prepare the Finding of Necessity ("FON"), pursuant to the Act, for the creation of a Community Redevelopment Agency in the neighborhood commonly referred to as "Allapattah" in the City, as more particularly described by the geographical boundaries as set forth in Exhibit "B" attached and incorporated herein; and WHEREAS, on January 23, 2025, the City Commission adopted Resolution No. R-25- 0022 which directed the City Manager to take any and all steps necessary to expedite the creation of the Allapattah Redevelopment District Community Redevelopment Agency ("Allapattah CRA"); and WHEREAS, BusinessFlare LLC. at the request of the City prepared the Redevelopment Plan for the Area ("Plan"), as attached and incorporated herein as Exhibit "A"; and WHEREAS, on April 10, 2025, the City of Miami ("City") Commission adopted Resolution No. R-25-0124, which accepted and approved the FON declaring the geographical boundaries as set forth in Exhibit "B," attached and incorporated ("Area"), to be slum and blighted, as defined by the criteria outlined in the Act and in need of redevelopment, thereby declaring the need to establish the Allapattah CRA; and WHEREAS, upon adoption, both the FON was transmitted by the City to Miami -Dade County (the "County"), pursuant to the requirements of the Act; and City of Miami Page 2 of 4 File ID: 19408 (Revision:) Printed On: 6/22/2026 WHEREAS, on October 23, 2025, the City Commission adopted Resolution No. R-25- 0443, which reiterated the need for the creation of the Allapattah CRA by urging the County to proceed with the establishment of the Allapattah CRA and requesting, pursuant to Section 163.410 of the Act, a delegation of powers from the County be granted to the City for the creation and operation of the Allapattah CRA; and WHEREAS, on November 3, 2025, the City transmitted a copy of Resolution No. R-25- 0443 to the County, pursuant to Section 163.410 of the Act; and WHEREAS, Section 163.410 of the Act, provides, in part, "the governing body of the county that has adopted a home rule charter shall grant in whole or in part or deny any request from a municipality for a delegation of powers or a change in an existing delegation of powers within 120 days after the receipt of all required documentation, or such request shall be deemed granted unless this period is extended by mutual consent in writing by the municipality and county"; and WHEREAS, March 3, 2026, marked the 120th day following November 3, 2025; and WHEREAS, accordingly, the 120-day period lapsed, thereby, pursuant to Section 163.410 of the Act, the City's request for the County's delegation of authority to proceed with the creation and operation of the Allapattah CRA is deemed granted; and WHEREAS, on April 9, 2026, the City adopted Resolution No. R-26-0161 which authorized the creation and operation of the Allapattah CRA in accordance with the Act; and WHEREAS, the Allapattah CRA is responsible for carrying out community redevelopment activities and projects within the Allapattah Area; and WHEREAS, Section 163.360(4), of the Act, provides that, "prior to its consideration of a community redevelopment plan, the community redevelopment agency shall submit such plan to the local planning agency of the county or municipality for review and recommendations as to its conformity with the comprehensive plan for the development of the county or municipality as a whole" (emphasis added); and WHEREAS, the Board of Commissioners desires, in accordance with Section 163.360(4), of the Act, to transmit the Plan to the local planning agency for review and recommendations; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE ALLAPATTAH REDEVELOPMENT DISTRICT COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. In accordance with Section 163.360(4), the Executive Director is directed to transmit the Plan, attached and incorporated as Exhibit "A", to the local planning agency for review and recommendations. Section 3. This Resolution shall become effective immediately upon its adoption.
