A RESOLUTION ACCEPTING THE COMPLETED
WORK OF HOWARD-PRICE COMPANIES (A
JOINT VENTURE) FOR THE CONSTRUCTION
OF WEST PINEMOUNT SANITARY SEWER
IMPROVEMENT SR-5233 C (CENTERLINE SEWER)
AND SR-5233 S (SIDELINE SEWER) IN WEST
PINEMOUNT SANITARY SEWER IMPROVEMENT
DISTRICT SR-5233 C (CENTERLINE SEWER)
AND SR-5233 S (SIDELINE SEWER) AT A
TOTAL COST OF $952,318.31; ASSESSING
$64,016.24 AS LIQUIDATED DAMAGES FOR
500 DAYS OVERRUN OF CONTRACT TIME AND
OTHER COSTS; AND AUTHORIZING, AFTER ALL
ADJUSTMENTS, A FINAL PAYMENT OF
$33,400.15.
WHEREAS, there exists a contract dated February 25, 1969
between The City of Miami and Howard -Price Companies (Joint Venture)
for the construction of WEST PINEMOUNT SANITARY SEWER IMPROVEMENTS
SR-5233 C (centerline sewer) and SR-5233 S (sideline sewer); and
WHEREAS, the work has been satisfactorily completed and
Howard -Price Companies (a joint venture) has furnished the required
documents certifying that all bills for labor, materials, etc.,
have been paid in full in connection with the aforesaid contract;
and
WHEREAS, a public hearing was held before the City Com-
mission on December 14, 1972 to hear any objections to the completed
improvements and no objections were sustained; and
WHEREAS, it is recommended that Howard -Price Companies
(Joint Venture) be assessed the following liquidated damages, ad-
ditional police charges, actual Court costs, and possible additional
Court costs:
a. Liquidated damages in the amount of $100.00
per day for 500 days for the period be-
ginning January 12, 1971 through May 26,
1972, in accordance with Section 1.40
of the General Conditions
$50,000.00
b. Police services required beyond the
contract time (from January 12, 1971
to completion of project) in accord-
ance with Section 2.13 of the Special
Provisions $ 4,029.00
c. Actual Court costs to date 8,987.24
d. Possible additional Court costs . . 1,000.00
Total Deductions $64,016.24
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. That the completed work performed by Howard -
Price Companies (Joint Venture) under contract dated February 25,
1969 for the construction of WEST PINEMOUNT SANITARY SEWER IM-
PROVEMENTS SR-5233 C (centerline sewer) and SR-5233 S (sideline
sewer) in WEST PINEMOUNT SANITARY SEWER IMPROVEMENT DISTRICTS
SR-5233 C (centerline sewer) and SR-5233 S (sideline sewer) be
accepted at a total cost of $952,318.31.
Section 2. That there be assessed against the Contract-
or the sum of $64,016.24 as liquidated damages for 500 days over-
run of contract time and other costs.
Section 3. That the proper officials of The City of
Miami be authorized and directed to pay Howard -Price Companies
(Joint Venture), after adjustments, a balance of $33,400.15 as
full and final payment for all work performed and all materials furn-
ished in connection with the contract for WEST PINEMOUNT SANITARY
SEWER IMPROVEMENT SR-5233 C (centerline sewer) in WEST PINEMOUNT
SANITARY SEWER IMPROVEMENT DISTRICT SR-5233 C (centerline sewer)
and SR-5233 S (sideline sewer).
